Kausik (Rejected) CRM (NDPS) 8 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Manikchak Police Station Case No. 205 of 2024 dated 12.03.2024 under Sections 20(b)(ii)(C)/29 of the NDPS Act, 1985. And In the matter of : Kalyani Sen ……Petitioner. Mr. Wasim Akram ……for the Petitioner. Mr. Partha Pratim Das Ms. S. Sultana ……for the State. Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with instant case for alleged recovery of 24 Kgs. of Ganja/contraband and she is in custody since 12.03.2024 and there has been no progress of the case. As such, petitioner may be released on bail. Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that out of 14 witnesses, 8 witnesses have already been examined and the last of the rejection in CRM (NDPS) 802 of 2025 was on 03.09.2025. In the said order it has been pointed out by the State that there was a direction for concluding the trial within a period of 8 months from the next date of hearing. The said 2 period is yet not complete and the petitioner has approached this Court. Having considered that the time period for compliance of the earlier order is still left, I am not inclined to release the petitioner on bail. Accordingly, CRM (NDPS) 8 of 2026 is dismissed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
