Dubey, Advocate For the State : Mr. Vishwanath Roy, APP …...... 02 /19.06.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 17(C), 18(b) and 25 of the NDPS Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned APP opposes the prayer for bail. 4. This is second attempt by the petitioner seeking prayer for bail. From the possession of the petitioner about 7 kg of opium was recovered from a room in poultry farm of the petitioner. It is said that on his pointing, recovery was made. FSL report also justified the fact that the material is opium. The recovered quantity is commercial in nature. 5. Considering the quantity which is commercial in nature and contraband is opium, and there is nothing in the entire petition or nothing could be gathered from the argument of the learned counsel for the petitioner which can satisfy the condition of section 37 of the NDPS Act, I am not inclined to 2026:JHHC:17829 2 grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Chatra Sadar PS Case No. 346 of 2025 (NDPS Case No. 64 of 2026), pending in the Court of learned Sessions Judge-cum-Special Judge, NDPS Act, Chatra stands rejected. 6.
