This criminal appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter to be referred as 'the SC/ST Act’) has been filed on behalf of the appellant being aggrieved with the order dated 06.03.2026 passed by the learned Special Judge, S.C./S.T. (Prevention of Atrocities Cases), Bharatpur (hereinafter to be referred as ‘trial court’) in criminal case No.50/2026 for the offences under Section 115(2), 126(2), 308(2), 111(2)(a), 109(A) of BNS and Sections 3(1)(R)(S), and 3(2)(va) of SC/ST Act, 2015 arising out of FIR No.107/2026 registered at Police Station [2026:RJ-JP:12958] (2 of 3) [CRLAS-554/2026] Mathuragate, District Bharatpur for the offence under Sections 189(2), 115(2), 126(2), 308(2), 111(2)(a), 109(1) of BNS, 2023, whereby the trial court has dismissed the bail application filed on behalf of the appellant. 2. Heard the learned counsel for the appellant, learned Public Prosecutor as well as learned counsel for the complainant and perused the material on record. 3. Learned counsel for the appellant submits that the appellant has falsely been implicated in this case. He contends that no specific act has been attributed to the present appellant and that it is the co-accused Ajju who has been assigned a specific role. He further submits that no recovery has been effected from the present appellant. The appellant is in custody since 16.02.2026 with criminal past of three cases but all the cases are related to the offence of gambling. The trial of the case will take considerable time, therefore, the appeal presented by the present appellant may be allowed. 4. Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the appeal. 5. Considering the facts and circumstances of the case and submissions advanced by learned counsel for the appellant and without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the appeal filed by the appellant under Section 14-A(2) of SC/ST Act. 6. Accordingly, this criminal appeal filed under Section 14-A(2) of SC/ST Act is allowed and order dated 06.03.2026 passed by the learned trial court is set aside. It is directed that appellant-Jeetu S/o Devkumar, shall be released on bail provided he shall [2026:RJ-JP:12958] (3 of 3) [CRLAS-554/2026] execute a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
