…...... 03/ 24.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 126(2), 115(2), 118(2), 109, 3(5) and 304(2) of BNS.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.
3. Learned A.P.P. opposes the prayer for bail.
4. The case diary contains the statement of an eye witness, who is an independent witness namely, Binod Kumar. His statement is recorded in the case diary at para 22, wherein he clearly stated that petitioner and his brother surrounded the victim near the Railway ground. The petitioner caught the hand behind and the other stabbed him with a knife.
5. Considering the aforesaid fact and the statement of independent eye witness, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Hariharpur P.S. Case No.59 of 2025, pending in the Court of learned Judicial Magistrate, 1st Class at Dhanbad stands rejected.
