Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner – Mother Teresa College of Nursing seeking following reliefs :- “10.1 It is prayed that this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of BINI PRADEEP Digitally signed by BINI PRADEEP Date: 2026.02.13 17:47:19 +0530 2 the Petitioner Company from the possession of respondents for its kind perusal. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ commanding the Respondent Authority to issue renewal order for the clinical training permission for the academic session 2025-26. 10.3 Any other relief/reliefs, which this Hon'ble Court may think fit and proper in the facts and circumstances of the case, with cost of the petition, may also please be granted to the petitioner. 2. Learned Sr. counsel appearing for the petitioner submits that initially vide orders dated 07.11.2007 (Annexure-P/3) and 01.5.2019 (Annexure-P/13) passed by the respondent authorities, the petitioner-Institution was granted clinical training permission to use Dr. Bhimrao Ambedkar Smriti Hospital, Raipur, Community Health Centre, Murmunda, Distt. Durg and Primary Health Center, Murmunda, Distt. Durg for practical and experimental training of students. Such permission was also granted to the petitioner - institution for the years 2016, 2017, 2018, 2019, 2020, 2021, 2022, 2023, 2024 and till April 2025, thereafter, the petitioner again moved an application before respondent No. 2 for grant of clinical training permission to use aforesaid institutions for practical and experimental training for its students for the academic year 2025-2026, which has not been decided yet, thereafter, the petitioner filed representations dated 16.9.2025 vide Annexure P-19 and 21.11.2025 vide Annexure P-21 in this regard, but the same have also not been decided yet, therefore, learned Senior Counsel submits that this petition may be disposed of directing respondent No. 2/competent authority to decide application/representations (Annexures P-19 & P-21) filed by the petitioner for the said purpose within a specific time frame. 3 3. Learned counsel for the State/respondents submits that if the application/representation filed by the petitioner for renewal permission of clinical training for the academic sessions 2025-2026 is pending, the same shall be considered and decided expeditiously. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Perusal of record shows that applications/representations (Annexures P-19 & P-21) for the said purpose was filed by the petitioner in the month of September 2025/November, 2025, but the same have not been decided yet, reminder has also been sent by the Principal of petitioner-Institution in this regard, whereas, academic session 2025-2026 is said to be completed in the month of March, 2026. 6. Having considered the arguments advanced on behalf of the learned counsel for the petitioner and also having considered the aforesaid facts, respondent No. 2 is directed to decide the applications/representations (Annexures P-19 & P-21) filed by the petitioner-Institution for grant of clinical training permission to use Dr. Bhimrao Ambedkar Smriti Hospital, Raipur, Community Health Centre, Murmunda, Distt. Durg and Primary Health Center, Murmunda, Distt. Durg for practical and experimental training of students expeditiously preferably within a period of 30 days from the date of receipt/submissions of copy of this order. 7.
