PUBLIC PROSECUTOR The Court made the following:
THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL REVISION CASE NO: 154 of 2026 JUDGMENT:
The present Criminal Revision Case has been filed by the State, challenging the Order dated 06.01.2026 in Crl.M.P.No.745 of 2026 in C.C.No.238 of 2021 passed by the learned Additional Junior Civil Judge, Piler. 2. Heard Sri Pedapudi Reetesh, learned counsel for the petitioner and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3. The learned counsel for the petitioner submits that the petitioner could not appear before the trial court on the specified date, resulting in the trial Court issuing a non-bailable warrant against the petitioner. The petitioner has filed a petition under Section 70(2) of Cr.P.C. for recalling the warrant, which was returned due to the petitioner’s absence, questioning its maintainability. 4. The learned counsel for the petitioner requests that the Criminal Revision Case be disposed of with a direction to the petitioner to appear before the trial Court. 5. The learned Assistant Public Prosecutor would submit to pass appropriate Orders. 6. Considering the submissions made and on perusal of the material on record, the petitioner filed an application before the Court below to recall the non-bailable warrant issued against him and it is not that the police have
produced the petitioner before the Court, since he jumped the bail. In that view of the matter, as the petitioner was released on regular bail and due to medical reasons, he could not appear before the Court on 06.01.2026 for production of sureties, it is apposite to dispose of the present case with the following conditions; i. The petitioner shall appear before the concerned Magistrate Court and execute a personal bond for Rs.20,000/- with two sureties for a like sum each to the satisfaction of the concerned Magistrate Court. ii. The petitioner shall deposit Rs.10,000/- to High Court Legal Services Committee, within a period of one week from the date of receipt of the copy of this Order.
The Secretary, Legal Services Committee is directed to utilize the amount for the welfare of the children in Government Home or in any NGO Homes to purchase anything which they require. 6. Accordingly, this Criminal Revision Case is disposed of. Consequently, miscellaneous applications pending, if any, shall stand closed. __________________________________________ DR.
