A writ of certiorari quashing Annexure-A Orders dated 05.03.2026to hold enquiry on IA no.3 filed by the petitioner under Order VII Rule 10 CPC in G&WC No.124/2024 pending on the file of the 3rd - 3 - HC-KAR NC: 2026:KHC:21793 WP No. 10659 of 2026 Addl. Senior Civil Judge, Bangalore Rural at Bangalore and consequently issue a direction to expeditiously dispose Annexure-K, i.e, IA no.3 under Order VII Rule 10 CPC in G&WC No.124/2024 pending on the file of the 3rd Addl. Senior Civil Judge, Bangalore Rural at Bangalore. 2. And for such other order, direction and declaration as this Hon'ble court may deem fit in the facts and circumstances of the case, in the interest of justice and equity.” 2. Respondent herein has filed a G and WC petition No.124/2024 before the Court of Principal Senior Civil Judge, Bengaluru Rural, for custody of the child named Srija Srinath Venkat. On service of summons, the petitioner herein has appeared through the counsel and has filed an application under Order VII Rule 10 read with Section 151 of CPC praying to return the petition to the petitioner therein as the G & WC Court has no jurisdiction. In view of the above, without expressing any opinion on the merits of the case, the G & WC Court is directed to dispose of IA No.3 filed by the petitioner herein in accordance with law as expeditiously as possible by the end of June 2026.
