Order 12/02/2026
1. The petitioner has filed this writ petition with the following prayers:-
[2026:RJ-JP:6644] (2 of 3) [CW-2779/2026]
"It is, therefore, humbly prayed that this writ petition may kindly be allowed with costs and by an appropriate writ, order or direction- i) By an appropriate writ, order or direction, respondents may be directed to deal with the representation preferred by the petitioners; ii)
By an appropriate writ, order or direction, the respondents may be directed not to initiate any inquiry on the complaints made by Nisar Ahmad; iii) Any other writ order or direction which this Hon'ble Court deem just and proper in the
facts and circumstances of the case may kindly be passed in favour of the petitioner. iv) Cost of the writ petition may kindly be awarded to the petitioner."
2. It is stated by learned counsel for the petitioners that petitioner No.1 is presently holding the post of Village Development Officer, whereas petitioners No.2 and 3 were earlier holding the same post at Gram Panchayat Chhipa Barod, Panchayat Samiti Baran, District Baran. It is stated that so many frivolous complaints were made by one Shri Nisar Ahmad; however, all such complaints have been found to be incorrect and the enquiries were dropped against the petitioners. Now, the petitioners have also prayed for not initiating inquiry in respect of the complaints made by Shri Nisar Ahmad.
3. The writ petition is totally misconceived for the reason that no direction can be issued to respondent- Government for not initiating any proceedings, which are otherwise permissible under law. It goes without saying that as and when any disciplinary proceedings are initiated, such proceedings shall be strictly in accordance with the prevailing Rules.
[2026:RJ-JP:6644] (3 of 3) [CW-2779/2026]
4. No writ of prohibition can be sought by the petitioners only by showing their apprehension that one person Shri Nisar Ahmad has made complaint against them. Even otherwise, the petitioners have not impleaded Nisar Ahmad as party to the writ petition.
5. In view of above, there is no scope of interference in the instant writ petition, and the writ petition filed by the petitioners is hereby dismissed.
6. Pending application(s), if any, also stand(s), disposed of.
