No. 586 of 2025, on the file of Pulivendula Police Station, Y S R Counsel for the Respondent/complainant(S): 1. PUBLIC PROSECUTOR The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 1206/2026 ORDER : The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused for granting of pre-arrest bail in connection with F.I.R.No.. 586 of 2025 on the file of Pulivendula Police Station, Y.S.R. Kadapa District, registered for the alleged offences punishable under Section 108 of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard Sri K. Srinivas, learned Counsel for the petitioner and Sri K. Sandeep, learned Assistant Public Prosecutor on behalf of the State. 3. The case of the prosecution, in brief, is that on 20.11.2025 at 12.00 noon, the accused abetted his wife (deceased) to commit suicide by saying that what is the use of her being alive, her health is not good, and if she dies, he will marry someone. Unable to digest his words, the deceased was vexed with her life and took an extreme step and committed suicide by hanging herself to ceiling fan with her chunny, and she died within four years of her marriage, and she wrote a suicide letter stating that do not want her husband and his relatives even to see her dead body. In this connection, a case was registered and investigated. 4. Learned counsel for the petitioner would submit that there are no allegations made against the petitioner in the report or in the suicide note, and that allegations were raised against the petitioner only during the course of the inquest. It is further submitted that the deceased was suffering from a psychiatric disorder, and the report also noted that she was of a sensitive nature, which may have led her to commit suicide. The petitioner neither abetted nor instigated the deceased in the commission of suicide. Learned counsel further submits that the petitioner is a Senior Design Consultant working in Hyderabad, has no criminal antecedents, and is a father of three dependent children. Learned counsel for the petitioner undertakes to abide by any conditions that this Hon’ble Court may impose and, in view of the above, prays that the petition be allowed on such terms and conditions as deemed appropriate by this Hon’ble Court. 5. Learned Assistant Public Prosecutor vehemently opposed the petition and submitted that the investigation in the present matter is not yet completed and is pending for examination of some crucial witnesses. The learned Assistant Public Prosecutor further submitted that the petitioner does not deserve the relief of anticipatory bail as a prima facie case has been established against him based on the material collected during the course of investigation. It is further contended that, if the petitioner is granted pre-arrest bail, there is every likelihood that he may tamper with the evidence and hamper the ongoing investigation. He, therefore, prayed for dismissal of the petition. 6. Considering the submissions made and upon careful perusal of the material on record, this is a case of abetment of suicide. The petitioner herein is the husband of the deceased, and as rightly contended by the learned Assistant Public Prosecutor, the investigation is still pending the examination of certain crucial witnesses. A prima facie case has been made out against the petitioner. Having regard to the nature and gravity of the offence alleged and the stage of the investigation, this Court is of the opinion that it is not desirable to grant anticipatory bail to the petitioner at this stage. 7. In view of the above said facts and circumstances, this Criminal Petition is dismissed. As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed. ___________________________________ DR.VENKATA JYOTHIRMAI PRATAPA, J Date: 23.02.2026.
