ORAL ORDER
The petitioner is before this Court calling in question the proceedings in C.C.No.65228/2025 registered for the offences punishable under Sections 85, 115(2) of the Bharatiya Nyaya Sanhita, 2023.
2. Heard Sri.Manjunath K.V.,
learned counsel appearing for the petitioner, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri.Shashank R, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the affidavits. The affidavit of the petitioner reads as follows:
"I, Mr. Anurag Verma, S/o KK Verma, Aged about 35 years, R/at No.4113, 11th Floor, Tower-4, Habitat Eden Heights, Near Hoodi Metro Station, Hoodi, Bangalore 560048 do hereby solemnly affirm and state on oath as follows. - 4 -

1. I state that, I am the petitioner in the above case. I know the facts and circumstances of the case. Hence I am swearing to this affidavit. 2. I state that me and Respondent No.2 are husband and Wife. Our marriage was solemnized in accordance with traditional Hindu rites and customs on 16/7/2021 at Hotel Kalchuri, Jabalpur, Madhya Pradesh. Out of the wedlock we have twin daughters and are aged about 3 years now. 3. I state that after marriage the petitioners have moved to Bengaluru and are permanent residents of Bengaluru. 4. Due to temperamental differences and misunderstandings, disputes arose between me and Respondent No.2, as a result, a complaint dated 31-05-2025 was filed by Respondent No.2 against me, before the 1st respondent Police, leading FIR No. 43/2025 dated 31-05-2025 at 1st Respondent Women Police Station for offences punishable under Section 85 and 115(2) of BNSS. Pursuant thereof, the 1st Respondent Women Police Station have filed a chargesheet in C.C.No.65228/2025, on the file of XXIX Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru implicating the Petitioner herein for the aforesaid alleged offences. 5. I state that me and the Respondent No.2, with the intervention of elders and well-wishers, in our own interest and in the interest of our children, have now resolved all our differences. 6. I state that me and Respondent No.2 have decided to save our marriage and have already resumed living together as husband and wife under one roof. 7. I state that me and Respondent No.2 state that we have no grievances against each other and their respective families in any manner. Hence both do not intend or wish to pursue the complaint and pursuant FIR and prosecution arising out of the same.
Further in the interest of the entire family and children we have reconciled marital life with a resolve to stay together. - 5 -

Since me and Respondent No.2 have amicably settled the differences continuation of the proceedings against this Petitioner would not serve the ends of justice and would be an abuse of process of law. 8. I state that no prejudice or loss will be caused to any of the parties to the proceedings, whereas both me and Respondent No.2 will be put to great loss or prejudice if the same is not allowed. Hence the application deserves to be allowed. Wherefore, I pray that, this Hon'ble Court may be pleased to permit the Petitioner and the Respondent No.2 to compound the offences consequently, quash the proceedings in C.C.No.65228/2025, on the file of XXIX Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru arising from Crime no. 43/2025 registered by Whitefield Women Police, Bengaluru for the offences punishable under sections 85,115(2) of The Bharatiya Nyaya Sanhita (BNS), 2023, in the interests of justice."
The affidavit of respondent No.2 reads as follows:
"I, Mrs.Shilpa Kumari, W/o. Anurag Verma, Aged About 34 years, R/at No.4113, 11th Floor, Tower-4, Habitat Eden Heights, Near Hoodi Metro Station, Hoodi, Bangalore 560048, do hereby solemnly affirm and state on oath as follows. 1. I state that, I am the Respondent No.2 in the above case. I know the facts and circumstances of the case. Hence I am swearing to this affidavit. 2. I state that me and Petitioner are husband and Wife. Our marriage was solemnized in accordance with traditional Hindu rites and customs on 15/7/2021 at Hotel Kalchuri, Jabalpur, Madhya Pradesh. Out of the wedlock we have twin daughters and are aged 3 and half years now. 3. I state that after marriage me and Petitioner moved to Bengaluru and are permanent residents of Bengaluru. 4.

In the light of application for compounding being filed along with the affidavits and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition. 5. For the aforesaid reasons, the following:
ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.65228/2025 pending before the XXIX Addl. Chief Judicial Magistrate, Mayo Hall, Bengaluru, stand quashed, qua the petitioner.
