[2026:RJ-JP:6238] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2486/2026 Vikas Singh S/o Shri Dinesh Kumar, R/o Khajpur Naya, Police Station Bagad, District – Jhunjhunu (At present in Judicial Custody at District Jail Jhunjhunu) ----Petitioner Versus State of Rajasthan, through Public Prosecutor ----Respondent For Petitioner(s) : Mr. Yash Sharma with Mr. Harsh Lodha For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 10/02/2026 1. This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No. 1/2026 registered at Cyber Police Station Jhunjhunu, District Jhunjhunu for offence under Section(s) 318(4), 316(2) B.N.S, 66-D of IT Act. 2. Learned counsel for the petitioner submits that the petitioner, who is an innocent person, has been falsely implicated in this case and he has nothing to do with the alleged offences. Learned Counsel further submits that the petitioner’s name is not mentioned in the FIR and the alleged amount of Rs. 1,95,000/- was received by co-accused namely, Pravindra Kumar from the complainant. He also submits that the only case against the petitioner is that out of said amount of Rs. 1,95,000/-, Pravindra Kumar transferred Rs. 1,00,000/- to the petitioner’s account, which were withdrawn by the petitioner. 3. Learned counsel also submits that co-accused Pravindra has entered into settlement with the complainant and the alleged [2026:RJ-JP:6238] (2 of 2) [CRLMB-2486/2026] amount of Rs. 1,95,000/- has already been returned to the complainant which has also been recorded in the order dated 29.01.2026, passed by Sessions Judge, Jhunjhunu while rejecting the bail application filed by the petitioner. He further submits that the offences are triable by Magistrate. He also submits that no recovery is required to be made from the petitioner, so no fruitful purpose would be served by keeping the petitioner into custody and therefore, prays to enlarge the petitioner on bail. 4. Per contra, Learned Public Prosecutor vehemently opposes the bail application. 5. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that the offences are triable by Magistrate, investigation and trial will take considerably long time in its conclusion, thus, without commenting anything on merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 6. Therefore, this bail application under Section 483 of BNSS is allowed and accused-petitioner Vikas Singh S/o Shri Dinesh Kumar is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so.
