The petitioner has filed this writ petition seeking following reliefs. “10.1 That this Hon'ble Court may kindly be pleased to quash/set aside the order dated 16.02.2021 (Annexure-P/1) issued by the Under Secretary, School Education Department, State of 2 Chhattisgarh. 10.2 That, this Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondent State to apply old pension scheme under Rule 1976 instead of NPS upon the petitioner. 10.3 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to grant the amount of gratuity after retirement calculating their service period from their date of initial appointment/joining. 10.4 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to refund the amount of NPS already deducted to the petitioner with the interest. 10.5. That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to deduct the GPF from the salary of petitioner instead of CPF” 2. Learned counsel for petitioner submits that the identical issue was considered by co-ordinate Bench of this Court in WPS No. 647 of 2021 decided on 23.01.2026 whereby, the State Government was directed to take decision on claim of the petitioner therein. Hence, the petitioner may also be granted similar relief. 3. Counsel for the respondent do not dispute the submission of counsel with regard to decision in WPS No. 647 of 2021 as also the submission of counsel for the petitioner that the claim of the petitioner is identical to the claim of the petitioner in WPS No. 647 of 2021. 4. On due consideration of the submissions made by learned counsel for the parties, this writ petition is disposed of in terms of the order dated 23.01.2026 passed in WPS No. 647 of 2021.
