Heard M/s Peeta Raman, learned counsel for the petitioners in both writ petitions and Sri S.Raju, learned Government Pleader for Services-I for respondent nos.1 to 13, Sri K.Venkata Rama Rao, learned standing counsel for respondent nos.18 and 19, Ms. Aishwarya Chowdary learned counsel appearing on behalf of Sri V.V.Satish, learned standing counsel for respondent nos.17, 20 to 23. 3. As the issue involved in both the Writ Petitions is one and the same, hence both the Writ Petitions are being disposed of with a common order by taking W.P.No.4351 of 2026 as a leading case. 4. All the petitioners have been working as Shift Operators in respective 33/11 KV Sub-Stations since long time and the petitioners are expecting that their services would be absorbed/regularized in the light of B.P. (P&GE) Ms.No.36 dt.18.5.1997. Instead of considering the cases of the petitioners for regularization, the respondents now trying to convert the services of the unofficial respondents by converting and also upgrading the services of Energy Assistants/ Junior Linemen Grade-II of the respondents 3, 8 to 13 and 18, as the post coined by the Government of Andhra Pradesh in G.O.Ms.No.110 Panchayat Raj & 30 Rural Development dated 19.7.2019. The petitioners further stated that they are working as shift operators on outsourcing basis in various sub- stations between 2007-2016 though their appointments were on contract basis. But after 2019, their nature of employment has got switched out from outsourcing to contract basis. 5. While the things stood thus, basing on the letter of the Joint Action Committee dated 03.11.2025 resolution passed on negotiations and minutes of meeting were drawn. According to the said minutes, one of the issue is with regard to finalization of the report by the Committee constituted vide T.O.O.Ms.No.3615 dated 17.5.2025 in respect of the Junior Linemen (hereinafter referred to as JLM) Gr.II (Energy Assistants). As the said issue was considered and agreed for conversion of JLM Grade-II as JLM for those employees who had completed five years of continuous service. Thereafter in each cadre a minimum additional service period of two (02) years will be observed over and above existing service period in (O.S.S) rules non statutory rules, accordingly, the O.S.S non statutory rules will be amended. The APSEB service regulations, leave regulations, disciplinary and appeal regulations are deemed to be applicable on conversion, and regulations pertaining to JLM Gr-II will be dispensed with thereafter. Pursuant to the said minutes, the Transmission Corporation of A.P has issued 31 proceedings that of JLM Gr.-II employees who have completed a minimum of five years of continuous service shall be converted to the cadre of Junior Lineman (JLM). Where the number of JLM posts are not available, the eligible JLM Gr.-II, into JLMs, the sanctioned JLM Gr.-II in the DISCOM posts may be upgraded as per prevailing rules. Consequent to that the SPDCL has issued S.O.O.Ms.No.2087 dated 07.11.2025. Aggrieved by the said action, the present Writ Petitions are filed. 6. The primary contention of the petitioners is that conversion and upgradation of employees of Panchayath Raj Department to the Corporation is unknown to law. Further there is no cadre/post of JLM Gr-II or Energy Assistant in the Corporation. Once without having any post in the respondent Corporation, the question of conversion/upgradation would not arise. 7. Further learned counsel for the petitioners has submitted all the posts which were filled/appointed by the unofficial respondents and like persons are only based on the Government G.O.Ms.No.110 dated 19.7.2019 which is issued by the Panchayatraj and Rural Development Department which comes under Gramapanchayt and Village Secretariat system. Hence all the persons those who were appointed in the 32 Panchayatraj Department are not entitled to be converted in the respondent Corporation by upgrading as JLM’s. 7. To support his contentions learned counsel for the petitioners has made his submissions that initially G.O.Ms.No.110 dated 19.7.2019 was issued based on the constitutional provisions more particularly under Article 243-G of the Constitution of India. As per 73rd amendment, the Government of Andhra Pradesh enacted the Panchayat Raj Act 1994, the said Act provides creation of three tier system of PRIs- Gramapanchayat at the village level, Mandal Parishad at the intermediate level and Zilla Panchayat at the district level. As per the functions at Schedule XI of the Constitution of India, the State has formulated a scheme of establishing Village Secretariat System. In the said system Annexure-I provides 29 functionaries in that non- conventional energy sources is one among them. Annexure-II deals with designation of the posts and according to Annexure II serial no.8 is Energy Assistant. Duties and functions enacted in that is power supply and street lighting, provide service connections and coordination with DISCOMs, renewable energy. It clearly describes that the Energy Assistant has to coordinate with the staff of DISCOM. That itself shows that they are not the employees of the DISCOM. Basing on the above said G.O.Ms.No.110 dated 19.7.2019, to cater the needs of the village 33 secretariat system, the SPDCL has issued notification for filling up the post of Energy Assistant/JLM Gr-II. Further even on perusal of the notification also clarifies that the selected candidates will be allotted to the village secretariats/ward secretariats to look after the power supply and street lighting and to provide service connection under the guidance of DISCOM staff and coordinator between DISCOM staff and renewable energy staff and village and ward secretariat. That itself shows the persons those who are appointed pursuant to the notification dated 27.9.2019 is not in the DISCOM employees and only staff of Panchayat Raj Department. Hence the person those who are appointed to work in Panchayat Raj Department cannot be converted to the post of JLM’s i.e. respondent Corporation, those are not sanctioned post of DISCOMS. Accordingly the proposed action of the respondents is not only contrary to service regulations but also contrary to service jurisprudence. Without having any lead, the respondents ought not to have convert the posts which are in Panchayat Raj Department into respondent Corporations. 8. Refuting the said submissions, learned standing counsel appearing on behalf of the respondent nos.20 to 23 has made their submissions that all the petitioners are working as shift operators under outsourcing agency. They are not having any direct nexus with the 34 respondents, there is no employee and employer relationship between the petitioners and the respondents. The petitioners have no locus- standi to question the impugned action of the respondents. In fact, the minutes of the meeting were drawn, based on negotiations with Joint Action Committee of Employees and based on the minutes of the meeting the Joint Managing Director has forwarded and communicated the same to the Chairman cum Managing Director, APEPDCL on 24.10.2025. Accordingly the S.O.O.Ms.No.2087 was issued on dated 07.11.2025. By virtue of the impugned action of the JLM’s Gr-II, employees who have been completed five years of service were converted as JLM’s with a proposal to abolish JLM Gr-II. It is purely an administrative action and the petitioners have nothing to do with the action. The prayer of the petitioners is mis-conceived. When the petitioners are not working with the respondent corporation and the respondent corporation is not being paid any salaries, surprisingly without impleading the agency where the petitioners have been working, the petitioners have filed the present Writ Petition for payment of minimum time scale as per the observations made by the Hon’ble Apex Court in State of Punjab vs. Jagjit Singh1. 1 (2017) 1 SCC 148 35 9. Learned counsel for the implead petitioners further submit that as contended by the petitioners, the service rules would applicable only for gazette post and cadre post, and the field post, only O.S.S. non- statutory rules will applicable. He further submitted that all the unofficial respondents were appointed based on the notification issued by the respondent Corporation dated 29.7.2019. The said notification was issued by SPDCL, Tirupati likewise other DISCOMS. A perusal of the notification itself clearly shows the notification for Energy Assistants(Junior Lineman Gr-II). In the notification it is further clarified that the candidates on selection and appointed will be paid Rs.15,000/- per month as consolidated pay for a period of two(02) years. The selected candidates on appointment will be deployed to work in the village secretariats/ward secretariats established in the Gramapanchayat/ wards as per G.O.Ms.No.110 Panchayat Raj. 10. He has further made his submissions that procedure for selection describes conversion would be done based on 100 marks with maximum of 80 marks obtained in SSC and minimum 20 marks for service in A.P. DISCOM as contract workers. In fact, the petitioners were also eligible if they are working under the contract to participate in the said selection. But for the reasons best known they came with this Writ Petition without knowing that whether they participated in the 36 selection pursuant to notification dated 29.7.2019. Hence the notification itself clarifies that the appointees would deploy to work in the village secretariats clarifies that they are the employees of DISCOMS and after selection would deploy to Panchayat Raj Department. Hence the contention raised by the petitioners is baseless. As the unofficial respondents were all appointed and continued to work under the DISCOMS as Energy Assistants/Junior Linemen Gr-II basing on the negotiations the corporation has accepted and converted the posts as JLM and now they have prepared the eligibility list. By virtue of the interim orders granted by this Court, the respondents are not proceedings to implement the same and hence they are directly effected by the interim orders of this Court. 11. He further relied on the orders passed by the Division Bench of this Court in The Chairman and Managing Director and others vs. P.Nagendra and others in W.A.No.310 of 2024 and batch wherein the issue involved in the said Writ Appeal is that the petitioners were engaged in the year 1991 onwards and they are continuously working by treating them as contract workers and they are working in the sanctioned posts but though they are working under the contractor. Hence they filed for regularization of their services. Finally, the said Writ Petitions were allowed. Aggrieved by the same, the Corporations have 37 filed Writ Appeals and the batch of Writ Appeals were considered and disposed of with the following observations: 53. In our view, the question whether there is relationship of employer and employee between the writ appellant and the writ petitioners is a question of fact and for applying the judgment in the case of Suresh (supra), there should be a specific finding of said fact, may be after lifting of veil or piercing the veil. To record the finding, the material would be required, the evidence would be required and it will also have to be seen, whether the writ appellant was a licensed principal employer under the Contract Labour (Regulation and Abolition) Act, and the contractor(s), as named in the writ petitions, was a licensed contractor, as also whether there was any genuine contract system prevailing at the relevant point of time or not. Whether the contract labourers became employees of the principal employer in course of time and whether the engagement and employment through contractor was a mere camouflage and required to be established on the basis of requisite material. 54. In our view, Suresh (supra) cannot be placed reliance upon for direction for regularization in the absence of finding on the point of relationship of employer and employee. Finding on such an aspect for the first time cannot be recorded in the exercise of writ jurisdiction under Article 226 of the Constitution of India in view of R.K. Panda (supra). 55. There is also nothing to show that in spite of there being sanctioned posts, the services of the writ petitioners were not being regularized or that the writ petitioners were engaged against the sanctioned posts though it was the writ petitioners‟ case that they were engaged against sanctioned posts, but the same was denied by the writ appellant. So, if there were no sanctioned posts for regularization, non- regularization would not amount to unfair trade practice. 56. The writ appellants, though regularized the services of some persons, may be similarly situated, but that was under the directions in writ petitions/writ appeals, affirmed by dismissal of the S.L.P. There is no finding in the writ court‟s judgment that the writ appellants regularized the services of similarly situated persons of their own, under some scheme or otherwise, of their own, and discriminated the writ petitioners, in the matter of regularization, violating their constitutional rights under Article 14 of the Constitution of India. 57. 57. In Ganesh Digamber Jambhrunkar v. The State of Maharashtra 31 the petitioners therein were appointed in Shri Guru Govind Singh Institute of Engineering and Technology on contractual basis. Their appointments were made sometime in the year 2011. The issue which involved was as to whether by working for a long period of 38 time on contractual basis, the petitioners had acquired any vested legal right to be appointed in the respective posts on regular basis. The Hon‟ble Apex Court observed and held that continuous working of the petitioners therein had not created any legal right in their favour to be absorbed. The view taken by the learned single Judge, granting regularization, because the petitioners were working for last twenty years on contractual basis, in our view, is legally unsustainable. 58. So far as the maintainability of the writ petition is concerned when the determination of the lis, is dependent on question of facts, being involved, as in the present case, whether there was relationship of employer and employee between the writ petitioners and the writ appellants, on which there was no finding by Industrial Court or Labour Court as was the case of Suresh (supra) which had arisen from adjudication by the Industrial Tribunal, in our view, the writ petition would not be the appropriate remedy to be approached directly and particularly when the Labour Court / Industrial Tribunal have jurisdiction to consider and grant such relief, on determination of relevant factual aspects based on material/evidence before those Courts/Tribunals. 59. In view of the aforesaid discussion, our conclusions are: (i) As per both the judgments in Suresh (supra) or/and Umadevi (supra), there must be relationship of employer and employee. In Umadevi (supra), the appointment was by employer, might have been irregular and in Suresh (supra) there was a finding by the Industrial Tribunal that there was relationship of employer and employee between the workmen and based on such finding the High Court had decided the writ petition under Article 226 of the Constitution of India. In the present case, any such finding by the Labour Court / Industrial Tribunal is lacking. (ii) In the absence of any finding on the aspect of the relationship of the employer and employee between the writ appellants and the writ petitioners, the direction for regularization is unsustainable. (iii) The question whether there is relationship of employer and employee between the writ appellants and the writ petitioners is a question of fact. To record the finding, the material would be required. The evidence would be required. It will also have to be seen whether the writ appellant is a licensed principal employer and the contractor, as named in the writ petitions, was a licensed contractor. It will also have to be seen whether there was any genuine contract system prevailing at the relevant point of time or not, and whether the contract labourers became employees of the principal employer in course of time and whether the engagement and employment through contractor was a mere camouflage. All this is required to be established on the basis of requisite material, may be after lifting of veil or piercing the veil. (iv) Finding on the aforesaid factual aspects, for the first time, cannot be recorded in the exercise of the writ jurisdiction under Article 226 of the Constitution of India, in view of R. K. Panda (supra). (v) There is also 39 no finding if there was sanctioned posts on which the writ petitioners could be regularized. So, if there were no sanctioned posts for regularization, it cannot be said that the non-regularization would not amount to unfair trade practice. (vi) The writ petitioners might have worked for 20 years on contractual basis, but by working for a long time on contractual basis, the writ petitioners would not acquire any vested legal right to be regularized, in view of Ganesh Digamber Jambhrunkar (supra). (vii) The writ petition under Article 226 of the Constitution of India is not the appropriate remedy to be approached directly in such matters seeking regularization, and particularly, when the Labour Court / Industrial Tribunal have got the jurisdiction to consider such aspect and on the determination of the relevant factual aspects based on material they have jurisdiction to pass appropriate orders for regularization. (viii) The view taken by the learned single Judge, that the order in W.A.No.1478 of 1999 attained finality on dismissal of SLP by the Hon‟ble Apex Court, may be correct but to this extent only that the judgment in W.A.No.1478 of 1999 became final between the parties thereto. We are of the view that as the dismissal of SLP was by a non- speaking order and as in one of the matters (W.P.No.21947 of 1999), where the order was passed based in W.A.No.1478 of 1999, and the SLP against that order was also dismissed, the Hon‟ble Apex Court observed that “the question of law is however left open to be decided in an appropriate case”. Consequently, in view of the aforesaid, as also the law as laid down in Himanshu Dewan (supra) that in a non- speaking order of dismissal of SLP, the doctrine of merger does not apply, and further that the effect a non-speaking order of dismissal of SLP without anything more indicating the grounds or reasons for dismissal, by a necessary implication cannot be taken as acceptance of the reasons or the ratio of the judgment under challenge, the order in W.A.No.1478 of 1999 is not to be considered as final and binding as precedent and particularly in the absence of finding on material aspects, as discussed above, in the facts of the present cases. 60. Our conclusions on Point-A are as in Para-59 (supra). 61. In view of our conclusions on Point-A, we are of the view on Point-B, that the common judgment dated 31.01.2024 under challenge, cannot be legally sustained and deserves interference. 62. In the result, Writ Appeal Nos.310, 311, 312 & 313 of 2024 are allowed. The common judgment dated 31.01.2024, passed in W.P.Nos.15794, 32917, 15272 and 33147 of 2010 is set aside. Consequently, all the aforesaid writ petitions are dismissed. The writ petitioners, if so advised, may have their remedies before appropriate forum. No order as to costs. 40 12. In the above said judgment the Division Bench has considered elaborately discussed about the relationship of shift operators with the respondent corporation and finally held that the question of relationship of employer and employee and finally held that the Writ Petitions are not maintainable. 13. In the instant case also, all the petitioners are working as shift operators with the outsourcing agency on contract basis. Hence the question of regularization as requested by the petitioners would not arise in this case. Hence when the petitioners were not eligible for regularization as observed by the Division Bench, the petitioners have no locus-standi to question the action of the respondents more particularly conversion of post of unofficial respondents with that of Junior Linemen. Further they also relied on W.A.No.467 of 2023 wherein the Division Bench has considered and held as follows: 9) The reasons for the same are not far to seek. The same set of allegations, witnesses and evidentiary material would be appreciated by a trained Judicial officer on the one hand and the same would be appreciated by an enquiry officer, who is not a legally trained person on the other hand and it is inevitable that appreciation of the evidences & witnesses by the Law Courts has to be placed on a higher pedestal than the similar exercise by a nonjudicial & untrained layman. It is probably in such peculiar circumstances, the Hon‟ble Apex Court has deemed it just and necessary that the disciplinary proceedings await the findings of the criminal Court. 10) The law as laid down by the Hon‟ble Apex Court in M. Paul Anthony case (1 Supra) and G.M.Tank case (3 supra) has subsequently been appreciated by a larger bench consisting of three judges of the Hon'ble Apex Court in Shashi Bhushan Prasad vs. Inspector General, Central Industrial Security Force and Another 4 , 41 wherein the Hon‟ble Apex Court after appreciating the factual and legal components of the conundrum has categorically upheld the correctness of law as laid down in M. Paul Anthony case (1 Supra) and the Hon‟ble Apex court in Shashi Bhushan Prasad case (4 supra) has been pleased to observe and hold in „Para 20‟ as under: 20. The judgment in M. Paul Anthony case (supra) on which the learned counsel for the appellant has placed reliance was a case where a question arose for consideration as to whether the departmental proceedings and proceedings in a criminal case on the basis of same sets of facts and evidence can be continued simultaneously and this Court answered in para 22 as under: “The conclusions which are deducible from various decisions of this Court referred to above are: (i) Departmental proceedings and proceedings in a criminal case can proceed simultaneously as there is no bar in their being conducted simultaneously, though separately. (ii) If the departmental proceedings and the criminal case are based on identical and similar set of facts and the charge in the criminal case against the delinquent employee is of a grave nature which involves complicated questions of law and fact, it would be desirable to stay the departmental proceedings till the conclusion of the criminal case. (iii) Whether the nature of a charge in a criminal case is grave and whether complicated questions of fact and law are involved in that case, will depend upon the nature of offence, the nature of the case launched against the employee on the basis of evidence and material 4 (2019) 7 Supreme Court Cases 979 GN,J & HN,J W.A.No.467 of 2024 9 collected against him during investigation or as reflected in the charge sheet. (iv) The factors mentioned at (ii) and (iii) above cannot be considered in isolation to stay the departmental proceedings but due regard has to be given to the fact that the departmental proceedings cannot be unduly delayed. (v) If the criminal case does not proceed or its disposal is being unduly delayed, the departmental proceedings, even if they were stayed on account of the pendency of the criminal case, can be resumed and proceeded with so as to conclude them at an early date, so that if the employee is found not guilty his honour may be vindicated and in case he is found guilty, the administration may get rid of him at the earliest.” 11) In the above background, we have appreciated the ruling upon which reliance has been placed by the Respondents. Paras 3, 6, 7 and 8 reads as under: “3. The facts of the instant dispute as they emanate from the record are:- 6. Three different FIRs stood registered against him, under which he was arrested but later released on bail. In his written show cause to this Memorandum, the Delinquent employee contended that the disciplinary proceedings should be either dropped or closed since criminal cases were pending him, arising from the same set of transactions. 7. The appellant-bank proceeded to appoint an inquiry officer who, in his report, submitted that three out of four 42 charges stood established. The Delinquent Employee, again denying the charges, filed a response to that but was eventually dismissed from the services at the bank, vide the order of dismissal dated 28th March 2003. The departmental appeal filed by him, after due opportunity of hearing, was dismissed on 16th August 2004. 8. Aggrieved by the dismissal of the departmental appeal, the delinquent employee filed Writ Petition (Civil) No.12 of 2005 before the Gauhati High Court. The question before the said Court was: whether, in view of the Memorandum of Settlement dated 10th April 20023, the disciplinary proceedings against the delinquent employee (respondent) herein ought to have been stayed or not.” The above paras would reveal that facts on hand and the facts involved in the ruling, as recorded by the Hon‟ble Apex Court, are at a complete variance. In the instant case, the appellant has approached this Court at the stage of framing of articles of charges. On the contrary, the facts recorded by the Hon‟ble Apex Court in P. Zadenga‟s case (2 supra) would reveal that the delinquent employee had participated in the enquiry and thereafter has proceeded to contest the correctness of the enquiry. In those circumstances, the Hon‟ble Apex Court has been pleased to hold in paras 31 to 35 as recorded in paragraph 6 hereinabove. 12) This Court has no quarrel with the law laid down by the Hon‟ble Apex Court in P. Zadenga‟s case (2 supra). Whereas, as noted by this bench, the facts are at variance with the facts involved in the said case. A close perusal of the above ruling does not also disclose any observations which would derogate from law laid down by the Apex Court in M. Paul Anthony‟s Case (1 supra) and as upheld by the Larger Bench of the Hon'ble Apex Court in Shashi Bhushan Prasad‟s case. 14. Having considered the submissions of all the counsel and on perusal of the record, this Court has not found any appointment letter or letters of the petitioners and further the petitioners have not able to substantiate how they are effected by virtue of the impugned action of the respondents. The respondent authorities have considered the request made by the Joint Action Committee and after negotiations they came to a conclusion for conversion of some of their employees to that of JLM’s and more so, decided to abolish JLM Gr-II which is purely an 43 administrative action of the respondent Corporation. The petitioners have not able to establish how they are effected by virtue of the action. Though the counsel for the petitioners has argued that even if the petitioners are not treated as employees of the Corporation, if they were treated as unemployees, their rights would get effected that too without informing said posts and if the said posts were converted, they loose opportunity. To support his contention he could not able to place whether they have participated pursuant to the notification issued by the DISCOMS on 29.7.2019. When the petitioners have not made any assertion with regard to participation pursuant to the notification dated 29.7.2019, the present contention that they will loose the opportunity would not arise at this stage. As the respondents conversion of JLM Gr- II into JLM is purely an administrative action and in fact a perusal of the minutes also clearly stipulates that they also proposed for amendment of O.S.S. non statutory rules and that being the situation the filing of the present Writ Petition is only with an apprehension and baseless and taking observations made by the Division Bench of this Court in the above said Writ Appeals as the petitioners claim for regularization and for payment of minimum time scale also would not arise in this case as the Division Bench has held that the shift operators working under the 44 contractor, there is no direct employee and employers relationship with the Corporation. 15. In view of the same, both the Writ Petitions are dismissed as devoid of merits. The interim orders granted earlier stands vacated. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH Date: 24.02.2026 RD 45 THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION Nos.4351 of 2026 and 36659 of 2025 Dated: 24.02.2026 RD
