[2026:RJ-JP:7584] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2367/2026 Kamlesh S/o Rakhlaal, Aged About 23 Years, R/o Bhadoli, Police Station Boli, District Sawai Madhopur, Rajasthan (At Present Confined in Judicial Custody in Central Jail Sikar). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Manish Sharma For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 17/02/2026 1. The present second bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with F.I.R. No.193/2025 registered at Police Station Sadar Sikar, District Sikar for the offence(s) punishable under Section(s) 331(4) & 305(a) of B.N.S. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has nothing to do with the alleged offences. Learned counsel further submits that the complainant has turned hostile before the trial Court and the co- accused namely, Jagdish @ Prakash S/o Ramswaroop Urf Banshilal (S.B. Criminal Miscellaneous Bail Application No.16727/2025) has already been enlarged on bail by a Co- ordinate Bench of this Court vide order dated 19.12.2025. Learned counsel also submits that since the complainant has turned [2026:RJ-JP:7584] (2 of 3) [CRLMB-2367/2026] hostile, therefore, there are bleak chances of conviction of the petitioner in the present case; the offences are triable by the Court of Magistrate; he is in judicial custody since 23.06.2025 and conclusion of trial will take considerably long time, so no fruitful purpose would be served by keeping the petitioner into custody, and therefore prays to enlarge the petitioner on bail. 3. Learned Public Prosecutor opposes the submissions made by learned counsel for the petitioner and submits that eight cases of similar nature in the recent past are pending against the petitioner. 4. Taking into consideration the overall facts & circumstances of the case; the arguments advanced by learned counsel for the petitioner, the fact that the case is triable by Magistrate, the co- accused has already been enlarged on bail by a Co-ordinate Bench of this Court and trial will take considerably long time in its conclusion, thus, without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 5. Therefore, the bail application under Section 483 B.N.S.S. is allowed and the accused-petitioner, namely Kamlesh S/o Rakhlaal, is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so. 6. The accused-petitioner is directed to mark his presence before the concerned Police Station on the 20th date of every [2026:RJ-JP:7584] (3 of 3) [CRLMB-2367/2026] month till conclusion of trial. The SHO of the concerned Police Station shall forward petitioner’s attendance report to the trial Court on the same day of each month. 7. The accused-petitioner is also directed to submit his present address along with his mobile number and in case of any change, to again submit his address and mobile number to the concerned S.H.O. and the concerned S.H.O. shall verify the said address and his mobile number, from time to time. 8. In case of any breach of the aforementioned conditions, the learned Public Prosecutor shall be free to move the application against the accused-petitioner for cancellation of the bail before the concerned Court. 9. Office is directed to send a copy of this order to the concerned SHO for necessary compliance. (SANDEEP TANEJA),J AVINASH GULERIA /64
