This writ petition has been filed under Article 226 of the Constitution of India seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to set-aside the impugned order dated 10.05.2023(Annexure P-1) issued by the respondent no. 1, in the interest of justice. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to refund the recovered amount fo the petitioner with interest and also to grant gratuity and whole pension amount continuously at the earliest, in the interest of justice 10.3 Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.” 2. Learned counsel for petitioner submits that respondents have with held the dearness allowances and part of gratuity against which petitioner has submitted a representation on 06.02.2023, however representation submitted by petitioner has not been considered and therefore, direction be issued to respondent no. 1 to 3 to take decision on pending representation at the earliest. 3. Learned counsel for State submits that as petitioner is not pressing this writ petition on merits and is only seeking direction to concerned authority to take decision on representation, she is having no objection. If representation is already submitted, it will be considered in accordance with law. 3 / 3 4. On due consideration of submission made by learned counsel for the respective parties, nature of grievances as raised in this writ petition instead of keeping this writ petition pending, I find it appropriate to dispose of this writ petition at this stage permitting petitioner to submit fresh representation before respondent no. 1 and 2, and if such a representation is submitted, concerned authorities shall consider and decide the same, in accordance with law, expeditiously, preferably within a further period of 08 weeks from the date of receipt of the representation. 5.
