Petitioners herein seek quashing of FIR No. 378/2025 dated 08.10.2025, registered at Police Station Dwarka North, for commission of offences under Sections 318(4)/316(2) Bharatiya Nyaya Sanhita, 2023, (corresponding Section 420/406 IPC), along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. The FIR was registered on the basis of a complaint made by Mr. Sumit Goyal, Vice President of ISKON Dwarka, New Delhi. As per the allegations made in the FIR, he and his wife were involved in financial mismanagement, criminal breach of trust, destruction of records and theft of property and money belonging to ISKON. The alleged unauthorised divergence and misuse of temple’s funds was in the vicinity of Rs. 21,45,000/-. 3. When Petitioner No. 1 had, earlier, prayed for bail, this Court had referred the matter to mediation under the aegis of Samadhan, Delhi High Court Mediation and Conciliation Centre and pursuant thereto, the matter has been amicably resolved between the parties as is evident from terms of settlement recorded by the Mediation Centre in its proceedings dated 12.05.2026. 4. Chargesheet has been filed albeit charges have yet not been framed. 5. Mr. Sumit Goyal, Vice President of ISKON, is present in person is present in person. He has been duly identified by his counsel as well as by Investigating Officer. 6. As per settlement terms, the complainant i.e. ISKON, has agreed to accept sum of Rs. 20,00,000/- from Petitioners as full and final settlement of all their disputes. Respondent No. 2 has already received sum of Rs. 12,00,000/- and the payment of balance payment of Rs. 8,00,000/- has been made today by way of Demand Draft drawn on IDBI Bank.It is in the above said background that the quashing is being sought. 7. When asked, respondent No. 2 reiterates the terms of abovesaid settlement. He states that he would have 'no objection' if the FIR is quashed. FIR has been registered for commission of offence under Section 318(4) BNS (corresponding Section 420 IPC), which is compoundable in nature. 9. Keeping in mind the overall facts of the case and the fact that parties have settled all their disputes amicably and respondent no. 2 does not want to pursue his complaint against petitioners herein, continuing with criminal proceedings would serve no useful purpose. 10. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR. 11. Consequently, to secure the ends of justice, FIR No. 378/2025 dated 08.10.2025, registered at Police Station Dwarka North, for commission of offences under Sections 318(4)/316(2) Bharatiya Nyaya Sanhita, 2023, (corresponding Section 420/406 IPC), along with all consequential proceedings arising therefrom, is hereby quashed.Original affidavits, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Courtwithin four weeks from today, so that these become part of Trial Court Record. 12. The petition stands disposed of in aforesaid terms. 13. The pending application also stands disposed of in aforesaid terms.
