THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 4284 of 2026 ORDER:
The present writ petition is filed to declare the action of the 2nd and 3rd respondents in not permitting the petitioner to complete the Doctorate in Philosophy (Ph.D) Course purportedly on the grounds of non payment of extension fee and non completion of course in time as illegal and arbitrary. 2. The petitioner was registered for Ph.D course under the extramural category as an extramural research scholar in the year 2010. However, for various reasons specified in the affidavit, the petitioner could not complete the course within the time period specified for that course. As the petitioner is not being permitted to complete the Ph.D course by the Respondent University now, the present Writ Petition is filed. 3. The learned counsel for the petitioner relied on the judgment of this court in W.P.No.22561 of 2025, wherein this Court relied upon the judgment of the Coordinate Bench of this Court in W.P.No. 28977 of 2023 dated 04.04.2024 permitted the Petitioner therein to deposit the required fee within 10 days and directed the Respondent University to grant six (06) months time to the petitioner therein to submit Ph.D. thesis. 4. As the issue involved in the present writ petition is squarely covered by the order passed by the Coordinate bench of this court in W.P.No. 28977 of 2023 dated 04.04.2024, this Writ Petition is disposed of with the following directions: i) The petitioner shall pay the fee to the respondent University within a period of 10 days from the date of receipt of a copy of this order. ii) On such payment of fee, the respondent University shall grant six (06) months time to the petitioner to submit Ph.D. thesis, as a last chance. iii) There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _______________________ JUSTICE NYAPATHY VIJAY
