The State of West Bengal Mr. Sauradeep Dutta Mr. Himadree Ghosh …for the Petitioner The petitioner herein/defacto-complainant has prayed for a direction upon the court below for expeditious disposal of the proceeding being S.T. case no. 506 of 2006, presently pending before the learned Additional Sessions Judge, 1st Court, Uluberia. It is submitted on behalf of the petitioners that the charge was framed on 3rd February, 2009 and thereafter, in the year 2017, the evidence started. The prosecution proposes to examine 24 witnesses out of which they could examine so far only 2 witnesses. The instant proceeding is pending since 2002 and nobody knows when the trial would be concluded and as such, the petitioner is suffering a lot. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the State/opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party/State is hereby dispensed with. In view of the aforesaid facts and circumstances of this case, it appears that the prayer made by the petitioner is 2 justified in view of the long pendency of the matter for about 24 years, the instant application being CRR 4652 of 2025 is hereby disposed of with a direction upon the court below to conduct day to day trial and to make his best effort to conclude the trial preferably within a period of ten months from the next date of hearing without granting any unnecessary adjournment to either of the parties. This order is passed invoking this court’s jurisdiction under Section 529 of the BNSS.
