JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks the following reliefs: “ (i) This Hon’ble Court be pleased to call for the records in O.S. 7531/2022 at Annexure-R, pending on the file of the Hon’ble XXXIX Additional City Civil Judge, Bengaluru (CCH-40) Retyped and replaced vide Court order dated 09.03.2026 - 3 - HC-KAR NC: 2026:KHC:10924 WP No. 6567 of 2024 (ii) To set aside, the order dated: 20.02.2024 passed by the Hon’ble XXXIX Additional City Civil & Sessions Judge, Bengaluru (CCH-4-) on application filed by the plaintiff under Section 151 of Code of Civil Procedure, in O.S.No.7531/2022, at Annexure-R. (iii) To allow application filed by the plaintiff under Section 151 of Code of Civil Procedure, in O.S.No. 7531/2022 on the file of Hon’ble XXXIX Additional City Civil & Sessions Judge, Bengaluru (CCH-40), at Annexure-S. (iv) To pass such other order or Writ as this Hon’ble Court deems fit to grant under the facts and circumstances of the case. (v) For costs of this writ petition, in the interest of justice.” 2. Heard learned counsel for the petitioner and learned counsel for the respondents and perused the material on record. 3. When the matter came up before this Court on 18.03.2024, this Court passed the following interim order: “Issue emergent notice to the respondents. List after service of notice. In the meanwhile, pending disposal of the petition, the interim order dated 23.11.2022 passed by the trial court which was not extended by the impugned order, shall - 4 - HC-KAR NC: 2026:KHC:10924 WP No. 6567 of 2024 remain in force and continue to operate between the parties till the next date of hearing. In addition thereto, all further proceedings in O.S.No.7531/2022 pending on the file of XXXIX Addl.City Civil and Sessions Judge, Bangalore, are hereby stayed till the next date of hearing. Liberty is reserved in favour of respondents to seek vacation / modification of this order.” 4. The aforesaid interim order extending the interim order dated 23.11.2022 passed by the Trial Court, continues to remain in force and operate between the parties even till today. 5. Under these circumstances, with the consent of learned counsel for all parties, I deem it just and appropriate to dispose of this petition directing the trial Court to dispose of all the suits on merits and in accordance with law within a period of one year from the date of receipt of a copy of this order. 6. In addition there to, the interim order dated 23.11.2022 passed by the trial Court in the suit shall continue to remain in force and operate between the parties till disposal of the suit without prejudice to the rights and contentions of the parties. - 5 - HC-KAR NC: 2026:KHC:10924 WP No. 6567 of 2024 7.
