2 2, submits that the present appellant has already challenged the
order passed by the National Investigating Agency rejecting his bail application by filing a separate Criminal Appeal, which has been registered as CRA No. 378/2026. It is further submitted that the said appeal has already been admitted by this Court vide order dated 09.02.2026 and is pending consideration. 3
Learned counsel further submits that the present appeal pertains to Crime No. 04/2023, which was initially registered by the State authorities; however, upon transfer of the investigation to the National Investigating Agency (NIA), a fresh Crime No. 13/2025 has been registered by the NIA in respect of the same transaction. In view of such transfer and subsequent registration, the grievance sought to be raised in the present appeal substantially overlaps with the issues involved in CRA No. 378/2026 already pending before this Court. 4 In light of the aforesaid factual and procedural developments, and in
order to avoid multiplicity of proceedings and any potential conflict of orders, learned counsel for the appellant seeks leave of this Court to withdraw the present appeal. 5
Learned counsel appearing for the respondents, have no objection to the prayer made on behalf of the appellant. 6 Accordingly, the present appeal is dismissed as withdrawn. Sd/- Sd/-
