This is First anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.113/2025 registered at Police Station – Sanna, District-Jashpur (C.G.) for the offences punishable under Sections 296, 351(2), 333, 115(2) and 3(5) of Bhartiya Nyay Sanhita (for short BNS), 2023. Prosecution case in brief is that complainant Satundari Bai appeared before Police Station Sanna and lodged a report stating that on 24.11.2025, during the evening hours, she was present at her residence along with her husband, Mahlu Ram. At that time, her husband left the house stating that he was going to the shop of Baijnath Ram to purchase groceries and at about 6:00 p.m., near the shop of Baijnath Ram, the accused persons, namely Chhotu alias Maneshwar Giri, Kuldeep Chauhan, Bablu alias Laxmi Giri, and Devnarayan Giri, all residents of the same village, intercepted Mahlu Ram. Due to previous enmity, they abused him in filthy language, threatened to kill him, and assaulted him. Kuldeep Chauhan and Chhotu alias Maneshwar Giri assaulted Mahlu Ram with sticks on his waist, left hand, and legs, while Bablu alias Laxmi Giri and Devnarayan Giri assaulted him with hands and fists. It is further alleged that during the incident, the accused persons also assaulted Raju Ram, who was found on the road at some distance. Thereafter, while proceeding further, the accused went to the house of Reku Ram, forcibly entered the house, and assaulted his wife Jagmaniya Bai by kicking her while she was cooking, alleging that she had given evidence in court against them in relation to an old rivalry When Mahlu Ram questioned the accused as to why he was being assaulted, one of the accused struck him on the head, causing injuries. 3. Learned counsel for the applicant submits that the applicant has not committed any offence and he has been falsely 3 implicated in offence in question. He further submits that the applicant has been falsely implicated due to prior enmity; he has no criminal antecedents; the allegations are exaggerated; there is no fear of absconding; and he will cooperate with the investigation and abide by all conditions and the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned counsel for the State opposes the bail application and submits that there are specific allegations against the applicant. It is further submitted that the allegations reveal serious and violent conduct causing grievous injuries, use of stick, hand and fist and threats to life; the case involves multiple victims; the investigation is at a nascent stage. She further submits that one injured received grievous injuries therefore, applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the fact and circumstances of the case, submissions made by learned counsel for the parties and allegation levelled against the applicant, the role of the applicant, as narrated in the FIR, indicates active participation in the assault, also considering the injuries received by the injured, this Court is of the opinion that no case for grant of bail is made out at this stage. 4 7. Accordingly, the anticipatory bail application of the applicant– Lakshmidev Giri @ Bablu filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.113/2025 registered at Police Station – Sanna, District- Jashpur (C.G.) for the offences punishable under Sections 296, 351(2), 333, 115(2) and 3(5) of Bhartiya Nyay Sanhita (for short BNS), 2023, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
