[2026:RJ-JP:7346] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2245/2026 Premaram S/o Shri Girdhari, Aged About 40 Years, R/o Dhan Charnan, P.s. Surajgarh Sadar, District Churu (At Present Confined In District Jail Sikar). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Dharmendra Fageriya For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 16/02/2026 1. This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No.201/2025 registered at Police Station Nechhwa, District Sikar for offence(s) under Section(s) 3/8 of Rajasthan Bovine Animal (Prohibition of Slaughter and Regulation of Temporary Migration of Export) Rule, 1995 and Section 325 of BNS. 2. Learned counsel for the petitioner submits that the accused- petitioner has been falsely implicated in this case as he has nothing to do with the alleged offences. Learned counsel further submits that the offences are triable by Magistrate; the petitioner is in custody since 02.10.2025 and no recovery is required to be made from him. Learned counsel also submits that co-accused namely, Shivraj has already been enlarged on bail by a Coordinate Bench of this Court, in S.B. Criminal Misc. Bail Application [2026:RJ-JP:7346] (2 of 2) [CRLMB-2245/2026] No.17033/2025, vide order dated 19.01.2026. He further submits that the charge-sheet has already been filed in the matter and conclusion of trial will take considerably long time, so no fruitful purpose would be served by keeping the petitioner in custody, hence, he may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor vehemently opposes the bail application. 4. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the material available on record, the fact that the offences are triable by Magistrate, co-accused has been released on bail, charge-sheet has already been filed and conclusion of trial will take considerably long time, thus, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 5. Therefore, this bail application is allowed and accused- petitioner Premaram S/o Shri Girdhari is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.
