In Re:- An application for cancellation of anticipatory bail under Section 439(2) of the Code of Criminal Procedure, 1973 corresponding to Section 483(3) of the Bharatiya Nagarik Suraksha
2023.
And
In the matter of:- Jagrit Bhutoria .…petitioner
Mr. Sanjay Banerjee, Mr. Joydeep Bhattacharjee.
…for the petitioner.
Mr. Anand Keshari, Ms. Afreen Begum.
…for the State.
Mr. Sabyasachi Banerjee Sr.Adv., Mr. Anirban Dutta, Ms. Priyanka Mukherjee.
…for the Opposite parties.
Affidavit of service filed on behalf of the petitioner is taken on record. Memo of Evidence filed on behalf of the State is also taken on record.
Learned counsel appearing on behalf of the petitioner submits that the accused/opposite parties had fraudulently obtained an
order of anticipatory bail upon giving a false undertaking that documents sought by the Investigating Authority as noted in the Memo of Evidence would be provided by the petitioners, within seven days from the date.
Learned counsel appearing on behalf of the accused/opposite parties strongly opposes the application for cancellation of anticipatory bail and submits that relevant documents were supplied to the Investigating Agency, within seven days.
2
Learned counsel appearing on behalf of the State relies on the Memo of Evidence and submits that copies of relevant documents were supplied to the Investigating Agency, which are now being made part of the case diary. They submitted a copy of the following documents in respect of the Cityscape Developers Pvt. Ltd. i.e. the Minutes of the Meeting, Books of Account in pen drive, Memorandum and Articles of Association, Mou between Cityscape Developers Pvt. Ltd. and Suvriddhi Developers Pvt. Ltd. According to the State, the accused has complied with the
order passed by this Court on 21.01.2025. It appears that the accused/opposite parties had complied with the order of anticipatory bail passed by this Court earlier and supplied relevant documents to the Investigating Officer. Investigation is still going on. In view of such compliance, I do not find any merit in this application for cancellation of anticipatory bail. Accordingly, the same is rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
