This is a bail application for grant of anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter, ‘BNSS’), 2023, filed on the basis of apprehension of arrest in FIR NO. 133/2026 under Section 376 Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’) & 64(1)/77/79/351(2) Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’), P.S. C.R. Park. 4. Learned counsel for the petitioner submits that it is a case of a consensual relationship, and that the prosecutrix was in a relationship with the petitioner for two years. There was no promise of marriage, and subsequently, This is a digitally signed order. Learned APP for the State, who appears on advance notice, has drawn the attention of the Court to the FIR registered in the present case, wherein allegations have been made that not only sexual assault but also physical assault was committed by the petitioner, and that he blackmailed the prosecutrix by making obscene videos and photographs of her. 6. Learned counsel for the victim, who also appears on advance notice, submits that not only the petitioner but his friends also primarily intimidated the petitioner as well as her mother. 7. In the FIR, the prosecutrix has specifically mentioned that she and the petitioner lived in Himachal Pradesh, where she was also physically assaulted by the petitioner, and during the investigation, the other witnesses have corroborated this fact. 8. No doubt, the mobile phone as well as laptop of the petitioner have already been seized by the Investigating Officer (I.O.), but the FSL report is still awaited. 9. In view of the nature and gravity of the allegations levelled against the petitioner, including the allegations of sexual and physical assault, blackmailing the prosecutrix by making obscene videos and photographs, and the fact that the FSL report is still awaited, this Court is not inclined to grant the discretionary relief of anticipatory bail to the petitioner. 10.
