No.394/2004 (General Power of Attorney) dated 22.03.2004 recorded in Book No.4 Register and Doc. No.2009/2004 (Sale Deed) dated 08.04.2004, recorded in Book 1 Register maintained by the third respondent and reflected in the encumbrance certificate for the property morefully described in the prayer to this writ petition within a time frame to be fixed by this Court. 2. According to the petitioner, she has succeeded in the suit filed by the respondents 4 and 5. In view of the same, the alleged illegal entries referred to in the prayer to this writ petition have to be removed / deleted from the encumbrance certificate by the third respondent. The petitioner had given a https://www.mhc.tn.gov.in/judis WP No. 13786 of 2026 representation on 10.07.2025 to the third respondent for the aforesaid purpose. Since the said representation has not been considered till date, this writ petition has been filed. 3. Mr. P. Harish, learned Government Advocate accepts notice on behalf of the respondents 1 to 3. He would submit that the petitioner will have to present the civil court judgment passed in favour of the petitioner in order to enable the third respondent to reflect the same in the encumbrance certificate for the subject property. 4. The learned counsel for the petitioner, on instructions, would now submit that the petitioner is willing to present the civil court judgment obtained in favour of the petitioner against the respondents 4 and 5, which makes it clear that the registered documents, referred to in the prayer to this writ petition, are illegal entries made in the encumbrance certificate for the subject property. 5. Since no adverse orders are passed against the respondents 4 and 5, notice to the respondents 4 and 5 is dispensed with by this Court. 6. No prejudice would be caused to any of the parties, if the petitioner is allowed to present the civil court judgment obtained in favour of the petitioner against the respondents 4 and 5 pertaining to the property morefully described https://www.mhc.tn.gov.in/judis WP No. 13786 of 2026 in the prayer to this writ petition and pertaining to the alleged illegal entries, referred to in the prayer to this writ petition and on presentation of the same, the third respondent shall enter the same in the encumbrance certificate for the property morefully described in the prayer to this writ petition within a time frame to be fixed by this Court. 7. This Court is not expressing any opinion on the merits of the petitioner’s representation. 8. For the foregoing reasons, this Court directs the petitioner to present the civil court judgment in O.S.No.16 of 2010 dated 21.12.2011 on the file of the Subordinate Judge, Tambaram passed in favour of the petitioner within a period of two weeks from the date of receipt of a copy of this order. On presentation of the same, the third respondent shall register the said judgment in the encumbrance certificate for the subject property within a period of four weeks thereafter. 9. Accordingly, this writ petition is disposed of.
