This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties. 3. These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Chandanpur PS Case No. 258 of 2024 corresponding to S.T. Case No. 29/244 of 2025 (G.R. Case No. 716 of 2024) pending in the file of learned 3rd ADJ, Puri, for commission of offence punishable U/Ss. 103(1)/109(1)/ 3(5) of BNS, on the main allegation of committing murder of Kanha Mallick by assaulting him with a sharp cutting weapon. 4. In addition, the petitioner Aju Bhoi @ Ajay Bhoi has filed I.A. No. 321 of 2026 in BLAPL No. 4661 of 2026 and petitioner-Biju @ Bijaya Bhoi has filed I.A. No. 320 of 2026 in BLAPL No. 4734 of 2026 for grant of interim bail to attend the obsequies of mother/aunt. 5. Heard, Mr. Pradip Kumar Mallick, learned counsel for the petitioners in both the bail applications, Mr. P. Satpathy, learned Addl. PP and Mrs. Aditi Hota, learned counsel, who enters appearance for the informant in both the bail applications as well as in the IAs in Court today by filing Vakalatnamas which are taken on record, in these matters and perused the record including the copy of deposition of PWs.1 to 4. 6. Adverting to the interim bail of the petitioners, it appears that the mother of petitioner Aju Bhoi @ Ajay Bhoi has expired on 28.04.2026, but right now today is 20.05.2026, however, the petitioners have sought for interim bail to attend the obsequies of the deceased mother/aunt, but that must have been finished in the meantime. This Court, therefore, by taking into consideration the allegation and materials placed on record, is not in favour of granting interim bail to each of the petitioners, more particularly when the obsequies for the deceased must have been finished. 7. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-à-vis the accusations sought to be brought against them and regard being had to the materials placed on record together with the evidence of the witnesses, more particularly that of PWs.1 to 3, this Court hardly sees any reason to grant regular bail to the petitioners, more particularly when it is submitted by the learned counsel for the informant that PWs. 7 & 9, who are the independent eye witnesses to the occurrence have vividly described about the incident implicating the present petitioners. 8. Hence, these two regular bail applications as well as the I.As. for interim bail of the petitioners namely Aju Bhoi @ Ajay Bhoi (BLAPL No. 4661 of 2026 & I.A. No. 321 of 2026) and Biju @ Bijaya Bhoi (BLAPL No. 4734 of 2026 & I.A. No. 320 of 2026) stand rejected. Accordingly, these BLAPLs stand disposed of.
