2. This petition under Article 226 of the Constitution of India has been RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2026.02.13 10:38:12 +0530
2 preferred by petitioner seeking following reliefs:-
“10.1 That, the Hon'ble Court may kindly call for records pertaining to case of petitioner, in the interest of justice.
10.2. That, the Hon'ble Court may kindly be pleased to declare illegal and quash the impugned order / policy dated 24/09/2025 with proposed amendment in model bye laws no. 32 (1) and subsequent actions based upon amendment of bye laws, in the interest of justice.
10.3. That any other relief which this Hon'ble court may deem fit and just in the facts and circumstances of the case.”

Learned counsel for the petitioner/society would submit that vide impugned order dated 24.09.2025 (Annexure -P/1) issued by Deputy Registrar, Co-operative Societies, Raipur, District Raipur, the petitioner has been directed to make various amendments to the bye-laws of the petitioner society. He would further submit that if the said order (Annexure -P/1) is complied with, then several powers of the society will be extinguished. Hence, learned counsel prays that the instant petition may be admitted for hearing.
4. Per contra, learned State counsel submits that the impugned order (Annexure -P/1) is appealable under Section 77 of the Chhattisgarh Co-operative Societies Act, 1960 (hereinafter referred to as the ‘Act of 1960’), therefore, this petition is not maintainable.
5. Having considered efficacious alternative remedy available to the petitioner to challenge the impugned order (Annexure -P/1) by filing an appeal under Section 77 of the Act of 1960, I am not inclined to
3 entertain the instant petition invoking extraordinary jurisdiction of this Court, hence the same is disposed of. However, liberty is granted to the petitioner to avail aforesaid statutory remedy.
6. Accordingly, this writ petition is disposed of.
7. Pending interlocutory application(s), if any, stands disposed of. No
