1. This hearing has been done through hybrid mode. 2. This matter has been taken up today as 27.08.2026 was declared a Court holiday. 3. By way of the present petition, the Petitioners are seeking quashing of FIR No. 786/2022, registered at Police Station Shastri Park, Delhi, for the offences punishable under Sections 323, 341, 452 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), with Section 308 IPC having been subsequently added in the chargesheet, and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties. 4. Issue Notice. The learned APP accepts notice on behalf of the State. 5. The Petitioners and Respondent No. 2 are present before this Court and This is a digitally signed order. have been identified by their respective counsel and the Investigating Officer (‘IO’). 6. Briefly, the present FIR arises out of an incident dated 13.08.2022. Respondent No. 2/complainant alleged that the Petitioners had come to his residence and assaulted him. FIR No. 786/2022 was thereafter registered on 04.10.2022 under Sections 323, 341, 452 and 34 IPC. Section 308 IPC was subsequently added in the chargesheet. During the pendency of the proceedings, the disputes between the parties were amicably settled and Respondent No. 2 and Petitioner No. 1 executed a Memorandum of Understanding/Settlement Deed dated 07.04.2026. 7. On a query made by this Court, Respondent No. 2, who has been duly identified by the IO, has categorically stated that he has entered into the aforesaid settlement out of his own free will and without any pressure, coercion or threat. Therefore, he has no objection if the present FIR is quashed. 8.
In view of the above, considering that the parties have amicably resolved their differences out of their own free will and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9. Accordingly, FIR No. 786/2022, registered at Police Station Shastri Park, Delhi, for the offences punishable under Sections 323, 341, 452 and 34 IPC, with Section 308 IPC having been subsequently added in the chargesheet, along with all consequential proceedings emanating therefrom, This is a digitally signed order.
