Mishra, APP …...... 02 /20.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 191(1), 191(3), 190, 115(2), 352, 351(2), 351(3) and 109 of the Bhartiya Nyaya Sanhita and Section 27 of the Arms Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned APP opposes the prayer for bail. 4. The prosecution case is that in a land dispute between the parties this petitioner on provocation of his wife fired at the informant with the intention to kill him. 5. From the case diary it appears that the witnesses have supported the case of the prosecution. The co-accused also confessed before the police and admits the involvement of the petitioner in this case. Further the medical evidence also suggest 2026:JHHC:5234 2 that firearm has been used as the doctor took out pellet from the body of the injured. 6. Considering the fact that it is the petitioner who has shot the informant, at this stage, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Nirsa (MPL OP) PS Case No. 297 of 2025, pending in the Court of learned Judicial Magistrate, First Class, Dhanbad stands rejected. 7.
