NARENDRA PRASAD - 4 - HC-KAR NC: 2026:KHC:21816 WP No. 12444 of 2026 ORAL ORDER In this writ petition, the petitioners are seeking for a direction to the learned Principal Civil Judge and JMFC, Kunigal (for short the ‘Trial Court’) to dispose of I.A.No.18 filed under Section 151 of CPC, as expeditiously as possible. 2. For the sake of convenience, the parties herein are referred to as per their ranking before the Trial Court in Original Suit. 3. The petitioners/plaintiffs have filed a suit for declaration and injunction. Along with the plaint, the plaintiffs had also filed an application bearing I.A.No.17 under Order XXXIX Rule 1 and 2 of CPC. The Trial Court granted an order of temporary injunction on the said application. Since the defendants disobeyed the said order, the plaintiffs filed I.A.No.17 for police protection. The Trial Court has not passed any order on the said I.A.No.17. Aggrieved by the same, the petitioners - 5 - HC-KAR NC: 2026:KHC:21816 WP No. 12444 of 2026 approached this Court by filing a writ petition in W.P.No.5619/2026. 4. This Court by the order dated 20.02.2026 directed the Trial Court to dispose of I.A.No.17 filed in O.S.No.21/2022, as expeditiously as possible, within a period of two weeks from 24.02.2026. Thereafter, this Court on 07.04.2026 further extended the time period to two more weeks from that day. 5. Learned counsel appearing for the petitioner has submitted that, acting upon the instruction of the Trial Court, he has withdrawn I.A.No.17 and on the same relief, has filed I.A. No. 18 and that so far, no order has been passed on the said I.A.No.18. Hence, he is before this Court. 6. Be that as it may, all the parties have appeared before the Trial Court, and this Court on earlier occasion, on similar application, has already directed the Trial Court to dispose of the application filed by the plaintiff seeking - 6 - HC-KAR NC: 2026:KHC:21816 WP No. 12444 of 2026 for police protection within 15 days from that date. Now, I.A. No.18 is also filed seeking for the same relief. In spite of all the parties having appeared, the Trial Court has not passed any order on the same. The matter is now posted to 27.04.2026 before the Trial Court. Hence, this Court deems it appropriate to direct the Trial Court to dispose of the application I.A.No.18 on or before 30.04.2026. 7. Accordingly, the following order is passed: ORDER (i) The writ petition is disposed of. (ii) The Trial Court is directed to dispose of the application I.A.No.18 on or before 30.04.2026.
