Heard and considered.
A perusal of the record would show that the respondents had filed a transfer petition for transfer of suit before this Court which was registered as CTA No. 33/2017. The said petition was allowed by this Court in terms of order dated 17.08.2018 and the suit filed by the petitioners against the respondents was transferred from Srinagar to Jammu. It appears that the petitioners herein filed review petition bearing RP No. 53/2018 before this Court seeking review of order dated
17.08.2018. The said review petition was dismissed by this Court in terms of order dated 04.02.2020.
The petitioners, through the medium of present petition, are again seeking transfer of the suit from Jammu to Srinagar, on the similar grounds, on which they had sought review of the order dated
17.08.2018. Thus, the present transfer petition is in effect a second review petition filed by the petitioners against order dated 17.08.2018. Such a course is not legally permissible in view of the bar contained under Order XLVII Rule 9 of the Code of Civil Procedure. The petition is, therefore, dismissed leaving it open to the petitioner to avail appropriate remedy.
