(Presently Confining In Central Jail Jaipur). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Ankit Kumar, Adv. For Respondent(s) For Complainant : : : Mr. Devi Singh, PP Ms. Manju Dave, PP Mr. Sanjay Joshi, Adv. HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 05/02/2026 1. The instant second bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.378/2024, registered at Police Station Sadar Jaipur, District Jaipur (West), for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. It is contended that the first bail application of the accused-petitioner was dismissed by this Court vide order dated 07.01.2026, thereafter, the Police has already submitted the charge-sheet and the custody period of the petitioner has been almost three months, the matter is exclusively triable by the Magistrate, there [2026:RJ-JP:5334] (2 of 3) [CRLMB-2249/2026] are no criminal antecedents against the accused-petitioner and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor as well as learned counsel appearing on behalf of the complainant have vehemently opposed the grant of the bail application. It is contended that vide order dated 07.01.2026, this Court dismissed the petitioner's bail application, considering the facts that the petitioner has submitted a forged document by creating a false tenancy and taking over the possession of the disputed land. It is also contended that the petitioner was dispossessed after deploying of the Police force, the conduct of the petitioner is apparent, therefore, considering the aforesaid facts, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on the record. 5. Though the petitioner's first bail application was dismissed by this Court on merits, however, considering the fact that the charge-sheet has already been filed and further trial would take considerable time, the matter is exclusively triable by the Magistrate and there are no criminal antecedents against the accused-petitioner, therefore, without commenting anything upon the merits of the case, this Court deems it proper to enlarge the accused-petitioner on bail. 6. Accordingly, the instant second bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused- petitioner-Vinod Singh Nirwan S/o Shri Lilu Singh, in connection with FIR No.378/2024, registered at Police Station Sadar Jaipur, District Jaipur (West), shall be enlarged on bail [2026:RJ-JP:5334] (3 of 3) [CRLMB-2249/2026] provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
