2 apprehending his arrest in connection with Crime No.435/2025, registered at Police Station – Mahasamund, District Mahasamund (C.G.) for alleged commission of offence punishable under Sections 296, 118(2), 115(2), 191(2), 191(3), 2 190, 3(5), 351(3) and 324(4) of BNS, 2023.
2. As per the prosecution case in brief, on 04.10.2025 a scuffle took place between the accused persons and residents of the complainant’s locality. Thereafter, in an attempt to resolve the dispute, the complainant along with Jalandhar Sonwani and Nirmal Singh went near Baronda Chowk, where the present Applicant, along with co-accused Aadi Chandrakar, Horilal Sahu, and Someshwar Sahu, allegedly assaulted them with sticks and rods, pursuant to which the FIR came to be lodged against the present Applicant. Hence, this application.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that the incident arose out of a quarrel between members of two families, in which the Applicant had merely intervened. It is further submitted that the charge- sheet has already been filed and there is no likelihood of the Applicant absconding or tampering with the prosecution
3 evidence. On these grounds, it is prayed that the Applicant be granted the benefit of anticipatory bail.
4. Learned State Counsel opposes the prayer for anticipatory bail and submits that the allegations against the Applicant are serious in nature. It is pointed out that three persons sustained injuries in the incident, out of whom one suffered grievous injury on the occipital region along with multiple injuries on the scalp, face, right leg, and left forearm. It is further submitted that, at this stage, grant of protection from arrest is not justified, particularly when the possibility of the Applicant influencing witnesses cannot be ruled out. Accordingly, rejection of the anticipatory bail application is prayed for.
5. After hearing learned Counsel for the parties and perusing the available material, this Court observes that the allegations against the Applicant are of a serious nature. The record shows that three persons sustained injuries in the incident and one of them received grievous injury on the occipital region along with multiple injuries on other parts of the body. Considering these circumstances and the apprehension that the Applicant may influence witnesses, this Court is not
4 inclined to extend the benefit of anticipatory bail. Accordingly, the application is rejected.

Accordingly, the bail application of the Applicant – Shubham Chandrakar filed under Section 482 of the BNSS, 2023 in connection with Crime No.435/2025, registered at Police Station – Mahasamund, District Mahasamund (C.G.) for alleged commission of offence punishable under Sections 296, 118(2), 115(2), 191(2), 191(3), 2 190, 3(5), 351(3) and 324(4) of BNS, 2023, is hereby rejected.
7. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information.
