Case No. 74 of 2025 for the offence registered under Sections 137(2), 96 read with Section 3(5) of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj, is pressed into motion. As per the FIR, minor daughter of the informant was attempted to be kidnapped by these petitioners at night along with other accused persons when she had gone out for attending religious congregation. When she raised hulla, the villagers gathered and rescued the victim girl. It is submitted by the learned counsel on behalf of petitioners that the petitioners were trying to take the victim on motorcycle, but they could not succeed. One of the co-accused has been granted bail as he was juvenile at the time of commission of offence. Learned A.P.P. opposed the bail petition. Considering the gravity of offence where the petitioners forcibly kidnap the minor girl from village itself, I am not inclined to enlarge the petitioners on bail.
