GP FOR HOME 2 The Court made the following ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ of Mandamus declaring the action of the Respondents in not registering an FIR despite the Petitioner's three successive written omplaints/representations dated 06-11-2025, 08-11-2025 (acknowledged vide No. 297/21 dated 08-11-2025) and the detailed complaint dated 15-11-2025 disclosing cognizable offences as illegal, arbitrary, without jurisdiction, irrational, malafide, violative of Articles 14, 15 and 21 of the Constitution of India Consequently Direct the Respondents, particularly Respondent Nos. 2 and 3, to immediately register an FIR under Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the cognizable offences against the accused based on the complaints dated 06-11-2025, 08-11-2025 and 15-11-2025 by conducting a fair, impartial and expeditious investigation into the said offences and submit a progress report of investigation before this Hon'ble Court within a time-bound period of four (4) weeks from the date of registration of FIR and Pass…” 2. Heard learned counsel for the Petitioner and the learned Assistant Government Pleader. 3. Mr. Karthik Siddhartha Saladi, learned counsel for the petitioner, submits that the petitioner, aged about 70 years, has submitted representations dated 06.11.2025 and 08.11.2025, vide acknowledgment No. 297/21 dated 08.11.2025, and a detailed further complaint dated 15.11.2025, seeking registration of crimes, but the respondent police have not registered any cases. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the complaints of the petitioner were considered and a preliminary enquiry was conducted under Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023. It was found that the complaints pertain largely to the management and control of the 3 company of the petitioner, namely Oxygenica Labs Pvt Ltd., situated at Plot No. 23-1, APIIC De-Notified SEZ, Atchutapuram, Anakapalli District. 5. Learned counsel for the petitioner submits that son of the petitioner by name Nithin has filed a petition in F.C.O.P.No.1480 of 2025 against the daughter-in-law of the petitioner wherein an order was passed, granting Ad-Inerim Injunction in favour of the son of the petitioner. 8. Having regard to the entire facts and circumstances of the case, the writ petition is disposed of, requiring the petitioner to file appropriate private complaint before the learned Jurisdictional Magistrate in accordance with law. 7. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.
