THE PETITION COMING ON FOR CONCILIATION BEFORE LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED: CONCILIATION ORDER The petition is filed by the Corporation assailing the award dated 27.04.2021 in Sa Ka Aa Ben-4/APGA/CR-7/2020-21 on the file of The Assistant Labour Commissioner & Appellate Authority under the Payment of Gratuity Act, 1972, Bengaluru and confirm the order dated 06.12.2019 in No.Ka Ba-6/PGA/CR-34/2017-18 3 passed by the Labour Officer and Controlling Authority under the Payment of Gratuity Act, 1972, Division -6, Bengaluru. 2. Learned counsel for the petitioner and respondent No.1 are present. 3. Parties to the proceeding have signed the joint memo reporting settlement. 4. Learned counsel for the petitioner/Corporation and respondent No.1/employee would submit that the dispute is settled and the parties have reduced the terms of the settlement in the joint memo. 5. The joint memo reads as under:- "JOINT MEMO The WP filed against the order in ALC-4/APGA/CR-7/2020-21 dated 24.07.2021 at PGA/CR/No.34/2017-18 dated 06/12/2019 passed by the Gratuity Authorities has been settled between the parties on the following terms and the award may kindly be modified as under: 1. The petitioner-Corporation has agreed to pay the Gratuity Amount of Rs.1,90,000/- including interest in full and final settlement of the case. 2. The respondent agreed to receive the above stated amount as full and final settlement. 3. The excess gratuity amount deposited by the Corporation should be refunded to corporation. 4 4. The parties to the proceedings have agreed for the above terms. 6. This Court does not find any impediment to accept the terms of the settlement. 7. Accordingly, the writ petition is disposed of. The impugned award dated 27.04.2021 in No.Sa Ka Aa Ben- 4/APGA/CR-7/2020-21 on the file of The Assistant Labour Commissioner & Appellate Authority and the order dated 06.12.2019 in Ka Ba-6/PGA/CR-34/2017-18 passed by the Labour Officer and Controlling Authority under the Payment of Gratuity Act, 1972, Division - 6, Bengaluru are modified in terms of the joint memo.
