[2026:RJ-JP:6866] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2312/2026 Hoshiyar Singh S/o Shri Gyarsilal, Aged About 34 Years, Dayal Ka Nagal, Police Thana Dabala District Sikar Rajasthan. ----Petitioner Versus The State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Satish Kumar Khandal For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 12/02/2026 1. This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No.149/2025 registered at Police Station Mehada, District Jhunjhunu, for the offence(s) punishable under Section(s) 316(2), 319(2), 318(4) & 61(2) B.N.S. 2. Learned counsel for the petitioner submits that the accused- petitioner, who is an innocent person, has been falsely implicated in this case and he has nothing to do with the alleged offences. Learned counsel further submits that the main allegation has been levelled against the co-accused, namely Nisha, who has already been enlarged on bail by a Co-ordinate Bench of this Court vide order dated 15.01.2026 in S.B. Criminal Misc. Bail Application No.571/2026 (Nisha v. State of Rajasthan). Learned counsel also submits that the accused-petitioner is in custody since 07.12.2025; charge-sheet has already been filed in the matter and no recovery is required to be made from the petitioner. He further submits that the case is triable by a Court of Magistrate and trial will considerably take long time in its [2026:RJ-JP:6866] (2 of 2) [CRLMB-2312/2026] conclusion, so no fruitful purpose would be served by keeping the petitioner in custody, therefore, the benefit of bail under Section 483 B.N.S.S. may be granted to the accused-petitioner. 3. Per contra, learned Public Prosecutor opposes the submissions made by learned counsel for the petitioner hereinabove and submits that the accused-petitioner has two criminal antecedents. 4. In response to the fact of having two criminal antecedents against the petitioner, learned counsel for the petitioner submits that the aforesaid two criminal cases pertain to year 2008 & 2018, however, no offence has been committed by the petitioner in recent past. 5. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that charge-sheet has already been filed, the co- accused has already been granted bail by a Co-ordinate Bench of this Court as well as the case is triable by a Court of Magistrate and trial will take considerably long time in its conclusion, thus, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 6. 6. Therefore, the bail application under Section 483 B.N.S.S. is allowed and the accused-petitioner, namely Hoshiyar Singh S/o Shri Gyarsilal, is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the Trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so.
