JUSTICE SHAMIMA JAHAN ORDER 12.10.2026 Heard Mr D Medhi, learned counsel for the petitioner and Mr D P Goswami, learned Additional Public Prosecutor for the State of Assam. 2. By this application, the petitioner has prayed for bail in connection with Golaghat PS Case No. 172/2025, registered under Sections 61(2)/314/316(2)/318(2)/ 336(2)/336(3)/340(2) of the BNS, 2023. 3. The petitioner submits that a complaint was filed by the wife of the deceased stating that she was approached by the petitioner along with an Advocate who took her Page No.# 2/3 signature in some documents and collected her Pan Card, on the pretext that an MACT case will be filed in connection with her husband’s death on 03.09.2026. It was also stated that the informant came to know on 24.03.2025 that an account was opened in her name and an amount of Rs. 5 lacs was withdrawn by one Subhash Deka and Rs. 3,90,000/- was withdrawn by the petitioner. 4. The learned counsel for the petitioner submits that the petitioner has been arrested in connection with the said offence on 22.08.2026, and he submits that without going into the merits, the petitioner be enlarged on bail for his incarceration for almost 52 days inside the jail. 5. Mr D P Goswami, learned Additional Public Prosecutor, on perusal of the Case Diary, submits that the petitioner along with others conspired and opened an account in the name of the victim and collected money of the victim therefrom, which was deposited by the Insurance Company. He, as such, submits that the petitioner has cheated the victim lady, and that no bail be granted to him, accordingly. 6. Upon consideration of the submissions made by the learned counsels, this Court finds that although the allegation against the petitioner is serious and that cheating of the lady is writ large in the FIR, but he has been inside the jail for the last 52 days and that the investigation is also at the conclusion stage as can be seen from the Case Diary, and also due to the fact that the petitioner was examined and the relevant documents were also seized, this Court deems it fit to release the petitioner on bail on furnishing bail bond of Rs. 20,000/-, with one local surety of the like amount to the satisfaction of the learned CJM, Golaghat under the following conditions:- i) the petitioner shall appear before the concerned IO and Court, as and when called for; without fail; ii) the petitioner shall not hamper and tamper with the evidence of the case, and/or influence the witnesses; and Page No.# 3/3 iii) the petitioner shall not leave his residence without prior permission of the Investigating Officer; and iv) the petitioner will not approach the victim informant at any point of time or any other victim and if it is found that he has approached and has continued with his alleged actions, the bail will be cancelled. 7. Bail Application stands disposed of. 8. Send back the Case Diary. JUDGE Comparing Assistant
