The complainants have filed the present complaint alleging willful disobedience of the order dated 30.08.2024 passed by the learned Single Judge of this Court in W.P.No.17168/2024 (EDN- RES) [impugned order]. The operative part of the said order reads as under: "ORDER i. The Writ Petition is hereby allowed. ii. The impugned order at Annexure-S dated 25.05.2023 passed by respondent No.3 is hereby set aside. iii. The matter is remitted back to respondent No.3 for reconsideration afresh, in accordance with law. iv. Respondent No.3 shall reconsider the request of the petitioners, afresh and pass appropriate order without insisting upon the petitioners for obtaining conversion of the subject property, within a period of four weeks from the date of receipt of a copy of this order." 2. The accused has filed an affidavit enclosing therewith an endorsement dated 27.01.2026, which indicates that the complainants' request for recognition had been denied, inter alia, on the ground that the school comprised of five rooms, none of which were of standard size; the school compound was incomplete and its toilet facilities were less than the prescribed requirements; - 4 - HC-KAR NC: 2026:KHC:19172-DB CCC No. 1527 of 2025 arrangement for drinking water is made through cans; the title documents of the land were not in the name of the Secretary of the school, but in the name of a private person; the building work was being carried on at the premises; and the school had already been closed. 3. The learned counsel appearing for the complainants submits that the grounds set out in the endorsement are ex-facie erroneous. He seeks to contest the same. 4. It is not necessary for this Court to examine the merits of the grounds on which the recognition has been rejected in these proceedings. The order, disobedience of which is alleged, requires the accused to consider the request of the complainants afresh without insisting on obtaining conversion of the subject property. However, we clarify that if the complainants are aggreived by the endorsement dated 27.01.2026, this order will not preclude the complainants from availing remedies, if any, in accordance with law.
