Accused nos.1 to 3 are before this Court in these two criminal petitions filed under Section 482 of Cr.P.C, R/w Section 528 of BNSS, 2023 with a prayer to quash the entire proceedings in C.C.No.37476/2022 pending before the Cuort of XXIV Addl. Chief Judicial Magistrate, Bengaluru arising out of Crime No.230/2022 registered by Basavanagudi Women Police Station, Bengaluru for the offence punishable under Sections 354(A), 506, 498A, 504 of IPC and Section 3 and 4 of Dowry Prohibition Act, 1961. - 4 - HC-KAR NC: 2026:KHC:12315 CRL.P No. 1685 of 2026 C/W CRL.P No. 9878 of 2023 2. Learned counsel appearing for the parties submit that the dispute between the parties has been amicably settled before the Mediation Centre at Bengaluru in M.C.No3030/2022 and it is agreed under the memorandum of settlement executed between the parties that entire proceedings in these two petitions could be closed /quashed. 3. The memorandum of settlement executed by accused no.1 and respondent no.2 herein is placed on record at Annexure-E to this petition. In paragraph nos.5 and 6 of the said memorandum of settlement dated 24.12.2025 it is stated as follows: "5. The Petitioner has agreed to pay a sum of Rs.20,00,000/-(Rupees Twenty Lakhs Only) to the Respondent as full and final settlement towards maintenance/permanent alimony by way of two demand drafts details as mentioned below: a) A demand draft bearing No.392411 dated 24.12.2025 drawn on The Karnataka State Co- operative Apex Bank Ltd., R.P.C.Layout Branch, Bengaluru for an amount of Rs.15,00,000/- (Rupees Fifteen Lakhs Only) and the same shall be handed over to the Respondent before the Hon'ble Court at the time of reporting this settlement in the above case. - 5 - HC-KAR NC: 2026:KHC:12315 CRL.P No. 1685 of 2026 C/W CRL.P No. 9878 of 2023 b) A demand draft bearing No.392412 dated 24.12.2025 drawn on The Karnataka State Co- operative Apex Bank Ltd., R.P.C.Layout Branch, Bengaluru for an amount of Rs.5,00,000/- (Rupees Five Lakhs Only) and the same shall be handed over to the Respondent at the time of closing C.C.No.37476/2022 pending before 24th ACMM, Bengaluru. In view of this settlement the Respondent has agreed to co-operate with the Petitioner in closing/quashing the proceedings in C.C.No.37476/2022 pending before the 24th ACMM, Bengaluru for the offences punishable under section 498A, 504, 354 (A) and 34 of IPC. Further the Petitioner has agreed to close Crl.P.No.6412/2023 pending the Hon'ble High Court of Karnataka, Bengaluru. 6. The Petitioner has agreed to return all the documents pertaining to the minor child at the time of closing C.C.NO.37476/2022 pending before 24th ACMM, Bengaluru to the Respondent." 4. Learned counsel for the respondent has today filed a memo stating that all documents relating to the minor child has been already returned by petitioner no.1 and there is no article to be returned by him. The said memo is taken on - 6 - HC-KAR NC: 2026:KHC:12315 CRL.P No. 1685 of 2026 C/W CRL.P No. 9878 of 2023 record. Under these circumstances, I am of the opinion that, the prayer made in these two petitions needs to be granted. 5. The Hon'ble Supreme Court in the case of RAMGOPAL AND ANOTHER Vs. STATE OF MADHYA PRADESH -2021 SCC ONLINE SC 834, has observed that notwithstanding the limitations provided under Section 320 of Cr.P.C, this Court, in exercise of its powers under Section 482 of Cr.P.C, can quash criminal proceedings registered even for non compoundable offences depending upon the nature and gravity of allegation, relationship between the parties and nature of settlement arrived between them. 6. In the case on hand the parties are all close relatives and they have come forward to compound the offences for which the petitioners have been charge sheeted. The charges are not grave in nature. Under these circumstances, I am of the opinion that, it is a fit case, wherein this Curt needs to exercise its inherent power to quash the impugned criminal proceedings so as do give complete justice to the parties, who are before this Court. 7. Accordingly, criminal petitions are allowed. Chief Judicial Magistrate, Bengaluru arising out of Crime No.230/2022 registered by Basavanagudi Women Police Station, Bengaluru for the offence punishable under Sections 354(A), 506, 498A, 504 of IPC and Section 3 and 4 of Dowry Prohibition Act, 1961 is hereby quashed.
