04/15.06.2026 Pursuant to the order dated 12.06.2026 the Officer-in-Charge of Radhanagar P.S. Case No. 435 of 2025 is physically present. He has submitted that on 08.06.2026 he had already submitted the case diary and antecedent reports to the learned Spl. P.P.
However, on 12.06.2026, it had been submitted by the learned Spl. P.P. that the antecedent report has not been received. It has been submitted by the learned Spl. P.P. that antecedent report has been received just now. She has accepted unconditional apology for the lapses on the part of her office. In view of the apology so submitted the same is accepted with a direction to the learned Spl. P.P. to be careful in future. Heard Mr. Gautam Kumar, learned counsel for the appellant and learned Spl. P.P. for the State. This appeal is directed against the order dated 21.04.2026 passed in B.P. No. 50/2026, arising out of Radhanagar P.S. Case No. 435/2025, by the learned District & Additional Sessions Judge-I, Rajmahal, whereby and whereunder, the prayer for bail of the appellant has been rejected. One Manish Kumar Rajbansi was apprehended by the locals and from his possession fake counterfeit currency notes were recovered. It has been submitted by the learned counsel for the appellant that the appellant has been implicated on the confession of Manish Kumar Rajbansi. It has been submitted that the appellant is in custody since 14.03.2026. Learned Spl. P.P. for the State has opposed the prayer for bail of the appellant and has admitted to the fact while going through the case diary that the only incriminating material against the appellant appears to be the confessional statement of Manish Kumar Rajbansi. She has further submitted that the appellant has seven criminal antecedents to which Mr.
Gautam Kumar, learned counsel for the appellant has submitted that none of the cases relate to counterfeit currency notes and the last case which was instituted against the appellant was in the year 2023. Regard being had to the manner of implication of the appellant, we while setting aside the order dated 21.04.2026 passed in B.P. No. 50/2026, arising out of Radhanagar P.S. Case No. 435/2025, by the learned District & Additional Sessions Judge-I, Rajmahal, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Rajmahal in connection with Radhanagar P.S. Case No. 435/2025. This appeal stands allowed. The personal appearance of the Officer-in-Charge of Radhanagar P.S. Case No. 435 of 2025 is dispensed with. (Rongon Mukhopadhyay, J.)
