JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused No.1 is before this Court calling in question registration of a crime in Crime No.105/2025, pending before the 11th Additional Chief Judicial Magistrate, Mayohall, Bengaluru, for the offences punishable under Sections 85, 351(2), 352 r/w. 3(5) of the BNS, 2023. 2. Learned counsel for the petitioner and respondent No.2 in unison submit that during the pendency of these proceedings, the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and conditions. The parties have filed an application – - 3 - HC-KAR NC: 2026:KHC:14074 CRL.P No. 839 of 2026 I.A.No.3/2026 under Section 320 r/w. 528 of the BNSS, 2023 supported by joint memo and joint affidavit are filed before this Court to that effect. 3. The memorandum of application filed under Section 320 r/w. Section 528 of the BNSS, 2023 reads as follows: “…. …. …. 4. Further submitted that the both petitioner and respondent no.2 have agrees that they have no grievance against each other and it was a case of criminal case lodged against the petitioners by the respondent no.2 since both are in the interest of their future and due to the intervention of the elders of the petitioners and the respondent no.2 both are agrees to close this criminal case as per the terms and conditions stated in this compromise petition before this Hon'ble court in the interest of justice and equity. 5. It is submitted that the respondent no.2 has agreed without force or coercion that they have no objection on quashing of the FIR No. 0105/2025 for offences punishable under sections - 85 351(2), 352, r/w 3(5), of BNS-2023, pending before the 11th Additional Chief Judicial Magistrate (Mayohall), Bengaluru, in the interest of justice and equity.
