1. GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following:
ORAL ORDER:
Heard Sri Dasani Venkata Ramana, learned Counsel for the Writ Petitioner; Sri Srinu Babu, learned Assistant Government Pleader for MAUD; and Sri M. Krishna Rao, learned Standing Counsel for the Municipal Corporation. 2. The averments in the Affidavit would indicate that there are disputes between the Writ Petitioner and the Unofficial Respondent No.3. The averments would also indicate that the Unofficial Respondent No.3 has filed a Police Complaint before the Station House Officer, Sarpavaram Police Station, Kakinada, which has been numbered as M.C.No.10 of 2025 under Section 164 of the BNSS, 2023, and the same is pending. 3. It also transpires that the Official Respondent No.2, namely, the Kakinada Municipal Corporation, has issued an Assessment Order dated 22.01.2026 (Ex.P.1) with regard to Vacant Land Tax. The present Writ Petitioner is seeking a direction to Respondent No.2 to assess the Vacant Land Tax payable by the Writ Petitioner in respect of the same subject property. 4. These facts would indicate that there is a dispute regarding Title and Possession between the Writ Petitioner and Unofficial Respondent No.3, which, in the opinion of this Court, is required to be sorted out before a competent Civil Court. 5. In this view of the matter, this Court is not inclined to entertain the present Writ Petition, since the Writ Petition is devoid of any merit. If the Writ Petitioner makes a request to Official Respondent No.2 to assess the Vacant Land Tax, the same may be considered and disposed of in accordance with law. 3
6.
Needless to state, the Parties are at liberty to approach the appropriate Forum for sorting out their disputes. 7. Accordingly , the Writ Petition is dismissed. No order as to costs. 8. Interlocutory Applications, if any, stand closed in terms of this order. ______________________________________ GANNAMANENI RAMAKRISHNA PRASAD, J
