JUSTICE PRAVEER BHATNAGAR [2026:RJ-JP:14941] (2 of 4) [CRLMB-4618/2026] Order 09/04/2026 1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.559/2025, registered at Police Station Vidhyadhar Nagar, District Jaipur City (North) for the offence(s) under Sections 190, 109(1), 115(2) and 126(2) of BNS. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. It is contended that the specific attribution of assault and causing injury to injured Afjal is against the other co-accused Sohel. The injury report of injured does not show any injury which can be termed as dangerous to life. The other similarly placed co-accused Arman Qureshi and Sohel Qureshi have already been enlarged on bail by the Co-ordinate Bench vide order dated 16.03.2026. It is further contended that the accused-petitioners are in custody since long and trial of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail applications and contended that the petitioners are a habitual offender and against them several cases are registered for various offences, therefore, the bail applications of the accused-petitioners may be dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioners and the fact that the other similarly placed co- [2026:RJ-JP:14941] (3 of 4) [CRLMB-4618/2026] accused have already been enlarged on bail by the Co-ordinate Bench and the injuries sustained to injured does not found to be dangerous to life and the period of incarceration of the accused- petitioners, therefore, without expressing anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely; 1. Anas Khan S/o Nisar Khan, 2. Arif @ Kilo S/o Shri Sabir Ali and 3. Mohammad Bilal Alias R.K. S/o Liyakat Ali, in connection with FIR No.559/2025, registered at Police Station Vidhyadhar Nagar, District Jaipur City (North), shall be enlarged on bail provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for there appearance before the court concerned on all the dates of hearing and as and when called upon to do so. The learned trial Judge shall also verify the addresses and the contact details of the surety through concerned S.H.O. before releasing the accused-petitioners on bail. 7. The accused-petitioners are also directed to mark their presence on 25th of every month before the concerned Police Station till conclusion of the trial. The SHO of the concerned Police Station is directed to maintain a regular register marking the presence of the accused-petitioners and shall send the presence report of the accused-petitioners on the same day to the concerned trial Court every month without any delay. In case of any breach of the aforementioned conditions, the learned Public Prosecutor shall be free to move the application against the [2026:RJ-JP:14941] (4 of 4) [CRLMB-4618/2026] accused-petitioners for cancellation of the bail before the concerned Court. 8. The accused-petitioners are directed to submit their present addresses along with their mobile numbers to the concerned S.H.O. within 7 days from their release and the concerned S.H.O. shall verify the said addresses and the mobile numbers. In case if the petitioners changes their addresses or mobile numbers they shall submit the same before the concerned S.H.O. and also before the concerned learned trial Court. 9.
