Learned counsel for the petitioner submits that the accused- petitioner, is an innocent person; has been falsely implicated and he has nothing to do with the alleged offences. Learned counsel further submits that there is no specific allegation against the petitioner and the other co-accused persons, namely Sourav Gurjar (S.B. Criminal Misc. Bail Application No.17188/2025) and Badal Goswami (S.B. Criminal Misc. Bail Application No.1441/2026), have already been enlarged on bail by a Co-ordinate Bench of this Court vide orders dated 19.01.2026 & 27.01.2026 respectively. [2026:RJ-JP:7560] (2 of 2) [CRLMB-2160/2026]
3. Per contra, learned Public Prosecutor opposes the submissions made by learned counsel for the petitioner hereinabove and submits that there is one criminal antecedent against the present petitioner.
4. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that co-accused persons have already been released on bail and trial as well as investigation are likely to take considerably long time in its conclusion, thus, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.
5. Therefore, the instant bail application is allowed and the accused-petitioner, namely Lovekush @ Kanha S/o Tarjan Singh, is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the Trial Court, with the following conditions:- (i) The accused-petitioner shall not tamper with evidence or influ- ence the witness in any manner.
