JUSTICE PRAVEER BHATNAGAR
Order 10/02/2026
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 15/2025 registered at Police Station Mandana District Kota (Rural) for the offences under Sections 126(2), 115(2), 110 and 189(2) of BNS.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case.
Learned counsel submits that material witness apart from the injured have not stated that petitioner assaulted injured Lokesh with other co-accused Suraj. Co-accused Suraj has already been enlarged on bail by this court vide order dated 26.08.2025 and case of the petitioner is not distinguishable from the case of other co-accused. It is also contended that petitioner's first and second bail applications were dismissed as withdrawn, however after
[2026:RJ-JP:6119] (2 of 2) [CRLMB-2460/2026] withdrawal of the first and second bail applications trial has proceeded and material eye witness have not supported the prosecution story. The accused-petitioner is in custody since 31.05.2025 and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and contended that injured PW-1 Lokesh in his court statement specifically attributed his injury to the present petitioner and also deposed that present petitioner was having axe in his hand and assaulted him which resulted into dislocation of his three fingers. Injuries were found to be grievous in nature, apart from the injury at his finger and injured also received multiple injuries on his shoulder, hand and legs, therefore considering the above facts, his bail application deserves to be dismissed.
4. Heard and perused the material available on record.
5. It is not desirable for the court to express anything on the merits of the case. Considering the statement of injured Lokesh and all the above facts, this court is not inclined to enlarge the accused-petitioner on bail.
6. Accordingly, the present third bail application of the accused- petitioner is dismissed.
