As per notification dated 13th November, 2025, the Commissioner has the authority to pass the order. The impugned order is therefore without jurisdiction and cannot be sustained. 2. In the result, the Writ Petition is allowed. The impugned order dated 28th July, 2026 passed by the Education Officer (Primary), Zilla Parishad, Latur is hereby quashed and set aside and the matter is remanded back to the Commissioner of Education, Maharashtra State, Pune to pass appropriate order in 2026:BHC-AUG:46693-DB {2} wp13272-26.doc the case of the Petitioner. 3. The Education Officer (Primary), Zilla Parishad, Latur – Respondent No.3 shall forward the proposal of the Petitioner to Commissioner of Education, Maharashtra State, Pune within two weeks from the date of receipt of copy of this order.
