Affidavit of service filed by the petitioner is taken on record. None appears for the Panchayat and Zilla Parishad despite service. The petitioner was issued work order for construction of individual household latrine by Suti-I Panchayat Samiti vide memo dated 11th February, 2022 and completed the said work in due time. An amount of Rs.16,32,000/- is due to the petitioner for the said work. The petitioner submitted an application before the concerned authority/ Block Development Officer and Executive Officer, Suit-I Panchayat Samiti, being the 4th respondent herein, for disbursal of the said amount on 18th December, 2023 followed by a demand notice issued on 23rd November, 2024 but to no effect. The petitioner seeks consideration of the same and disbursal of the due amount. Upon consideration of the submission made on behalf of the parties, this Court directs the 4th respondent to consider and dispose of the applications submitted by
2 the petitioners on 18th December, 2023 and 23rd November, 2024 respectively within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. In the event the concerned authority finds the petitioner entitled to the due amount, the amount shall be disbursed within a month thereafter. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
