Learned advocate appearing for the petitioner submits that the petitioner is in custody for 78 days and has been taken into custody on the basis of statement of co-accused. The subject matter of the case relate to alleged recovery of 502 grams of brown sugar, however there has been no recovery from the petitioner and is unnecessarily languishing in jail. Learned advocate for the State opposes the prayer for bail and submits that there are criminal antecedents of the present petitioner, although, there has been no recovery from him. Having considered the period of detention of the present petitioner, I direct the learned trial Court to release the petitioner on bail after the stage of consideration of charges are over. Learned trial Court/Special Court, as such is directed to split up the trial, if required, and proceed with an early target of consideration of the charges. 2 With the aforesaid observations CRM (NDPS) No. 661 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
