Order No.02 Dated- 16.06.2026
Heard the parties. The petitioner has moved this Court for grant of bail in connection with Meral P.S. Case No.132 of 2025 (G.R. No. 533 of 2026) registered for the offences punishable under sections 126(2)/115(2)/117(2)/118/109(1)/3(5) of the B.N.S., 2023. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons attempted to murder Sanjay Kumar Dwivedi as Sanjay Kumar Dwivedi asked the co-accused-Ajay Kumar Dwivedi to stop illegal construction over the land of Sanjay Kumar Dwivedi and the co-accused-Ajay Kumar Dwivedi assaulted Sanjay Kumar Dwivedi with a sharp edged axe causing injury to him and as he tried to run on the main road, the co-accused-Anurag Dwivedi drove his vehicle and tried to dash Sanjay Kumar Dwivedi for committing him murder. It is further submitted that the allegations against the petitioner are all false and the petitioner is not named in the FIR. It is then submitted that the only involvement of the petitioner is that some of the witnesses were under the impression that the petitioner was driving the vehicle which dashed Sanjay Kumar Dwivedi. It is next
submitted that in paragraph no. 97 of the case diary Sanjay Kumar Dwivedi-the injured person of the case, has categorically stated that it was Anurag Kumar Dwivedi who was driving the car and drove the car over Sanjay Kumar Dwivedi causing injury to him; which rules out the wrong impression that the petitioner was driving the car in question. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in paragraph no.13 of the bail application. It is then submitted that the petitioner has been in custody since 30.03.2026, as has been mentioned in paragraph no. 07 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. and the learned counsel for the informant opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail.
Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Garhwa, in connection with Meral P.S. Case No.132 of 2025 (G.R. No. 533 of 2026) with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
